1.3relating to commerce; regulating landscape application contracts; providing an
1.4exclusion;amending Minnesota Statutes 2016, section 325F.245, subdivision 6.

1.10We, the undersigned conferees for H. F. No. 676 report that we have agreed upon the
1.11items in dispute and recommend as follows:
1.12That the Senate recede from its amendments and that H. F. No. 676 be further amended
1.13as follows:
1.14Delete everything after the enacting clause and insert:

1.15    "Section 1. Minnesota Statutes 2016, section 325F.245, subdivision 6, is amended to read:
1.16    Subd. 6. Exclusions. This section does not apply to:
1.17(1) pesticide, fertilizer, or chemical applications for the purpose of producing agricultural
1.18commodities or any commodity for sale;
1.19(2) pesticide applications around or near the foundation of a building for the purpose of
1.20structural or indoor pest control; or
1.21(3) any single or isolated landscape application where the property owner or its agent
1.22verbally consents to the single or isolated application.; or
1.23(4) pesticide or fertilizer applications by a licensed, commercial application company
1.24that provides customers with the ability to cancel or discontinue the agreement at any time,
1.25for any reason, with full refund of any prepaid services that were not provided and without
1.26any cancellation or discontinuance penalty. Prior to the first application of the season, the
2.1commercial application company must provide annual written notice to the customer of the
2.2customer's ability to cancel or discontinue the agreement at any time. The customer must
2.3be allowed to cancel or discontinue the agreement at any time by communication to the
2.4company in writing, electronically, verbally by telephone, or in person to company
2.5representatives or on-site service personnel.

2.6    Sec. 2. EFFECTIVE DATE.
2.7Section 1 is effective the day following final enactment and applies to agreements entered
2.8into on or after that date."
2.9Delete the title and insert:
2.10"A bill for an act
2.11relating to commerce; regulating landscape application contracts; providing an
2.12exclusion;amending Minnesota Statutes 2016, section 325F.245, subdivision 6."
