  1.1                          A bill for an act 
  1.2             relating to data practices; providing for disclosure 
  1.3             of certain hospital and health care provider tax data 
  1.4             to the commissioner of human services and the United 
  1.5             States Department of Health and Human Services; 
  1.6             amending Minnesota Statutes 1994, section 270B.14, 
  1.7             subdivision 1.  
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 270B.14, 
  1.10  subdivision 1, is amended to read: 
  1.11     Subdivision 1.  [DISCLOSURE TO COMMISSIONER OF HUMAN 
  1.12  SERVICES.] (a) On the request of the commissioner of human 
  1.13  services, the commissioner shall disclose return information 
  1.14  regarding taxes imposed by chapter 290, and claims for refunds 
  1.15  under chapter 290A, to the extent provided in paragraph (b) and 
  1.16  for the purposes set forth in paragraph (c). 
  1.17     (b) Data that may be disclosed are limited to data relating 
  1.18  to the identity, whereabouts, employment, income, and property 
  1.19  of a person owing or alleged to be owing an obligation of child 
  1.20  support. 
  1.21     (c) The commissioner of human services may request data 
  1.22  only for the purposes of carrying out the child support 
  1.23  enforcement program and to assist in the location of parents who 
  1.24  have, or appear to have, deserted their children.  Data received 
  1.25  may be used only as set forth in section 256.978. 
  1.26     (d) The commissioner shall provide the records and 
  2.1   information necessary to administer the supplemental housing 
  2.2   allowance to the commissioner of human services.  
  2.3      (e) At the request of the commissioner of human services, 
  2.4   the commissioner of revenue shall electronically match the 
  2.5   social security numbers and names of participants in the 
  2.6   telephone assistance plan operated under sections 237.69 to 
  2.7   237.711, with those of property tax refund filers, and determine 
  2.8   whether each participant's household income is within the 
  2.9   eligibility standards for the telephone assistance plan. 
  2.10     (f) The commissioner may provide records and information 
  2.11  collected under sections 295.50 to 295.59 to the commissioner of 
  2.12  human services for purposes of the Medicaid Voluntary 
  2.13  Contribution and Provider-Specific Tax Amendments of 1991, 
  2.14  Public Law Number 102-234.  Upon the written agreement by the 
  2.15  United States Department of Health and Human Services to 
  2.16  maintain the confidentiality of the data, the commissioner may 
  2.17  provide records and information collected under sections 295.50 
  2.18  to 295.59 to the Health Care Financing Administration section of 
  2.19  the United States Department of Health and Human Services for 
  2.20  purposes of meeting federal reporting requirements.  
  2.21     Sec. 2.  [EFFECTIVE DATE.] 
  2.22     Section 1 is effective the day following final enactment.
