A bill for an act
relating to crime; limiting mitigated departure in sentencing when person convicted
of crime resulting in death; proposing coding for new law in Minnesota Statutes,
chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin When a person is convicted of a crime that results in the death of another person, the
court may not impose an executed sentence that is a mitigated durational or dispositional
departure from the presumptive sentence under the Sentencing Guidelines or a waiver of
any statutory mandatory minimum for that crime except when the mitigated durational or
dispositional departure or waiver is agreed to by the prosecutor in consultation with the next
of kin of the deceased person.
