A bill for an act
relating to liquor; allowing certain on-sale licensees to make off-sales of liquor.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin LIMITED OFF-SALE OF LIQUOR FOR BARS AND RESTAURANTS
CLOSED BY EXECUTIVE ORDER.

new text begin (a) Except as otherwise provided in paragraph (c), notwithstanding any other law,
ordinance, or charter provision to the contrary, a qualifying licensee may make off-sales of
malt liquor and wine, without obtaining an additional license, provided that:

new text begin (1) the sale of malt liquor and wine is made in conjunction with and is incidental to the
sale of food to the recipient of the beverages by the qualifying licensee;

new text begin (2) the alcoholic beverages are sold in their original, unopened packaging; and
new text end

new text begin (3) no more than 144 ounces in total of malt liquor, hard seltzer, and cider and 1.5 liters
of wine other than cider may be sold per food order.

new text begin (b) All laws and rules relating to the off-sale of liquor under Minnesota Statutes, chapter
340A, not inconsistent with this section apply to the sales allowed by this section, including
but not limited to Minnesota Statutes, sections 340A.502 and 340A.503.

new text begin (c) The governing body of a municipality may elect to prohibit the off-sale of alcoholic
beverages allowed under this section.

new text begin (d) For purposes of this section, "qualifying licensee" means the holder of an on-sale
intoxicating liquor or 3.2 percent malt liquor license whose on-sale premises are closed to
on-premises consumption of food and beverages under Executive Order 20-04, as modified
and extended under Executive Order 20-18, and any subsequent and related orders. All
other terms used in this section have the meanings given in Minnesota Statutes, section
340A.101.

new text begin EFFECTIVE DATE; EXPIRATION. new text end

new text begin This section is effective the day following final
enactment. This section expires the day that the governor's Executive Order 20-04, as
modified and extended under Executive Order 20-18, or other subsequent or related executive
order that provides for, modifies, or extends the temporary closure of bars, restaurants, and
other places of public accommodation has expired, or is terminated or rescinded.
