A bill for an act
relating to liquor; creating a wine sampling license that authorizes a farm winery
to provide samples and conduct tastings of wine at a farmer's market; amending
Minnesota Statutes 2016, section 340A.315, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 340A.315, is amended by adding a subdivision
to read:

new text begin (a) A municipality may issue a wine sampling license
to the holder of a farm winery license. A wine sampling license authorizes a farm winery
to provide free samples of wines produced by that farm winery at a farmer's market during
the hours authorized for on-sale of liquor in the jurisdiction where the farmer's market is
located. Wine may only be provided and consumed on the premises described in the license.
A municipality may issue a wine sampling license notwithstanding any local ordinance or
charter provision to the contrary. A sample may not exceed 50 milliliters, and only one
sample per variety per customer per day may be provided. The duration of a license issued
under this paragraph is one year, and the cost is $25. A farm winery may hold more than
one wine sampling license issued under this subdivision.

new text begin (b) A wine sampling license also authorizes a farm winery to conduct a tasting of wines
produced by that farm winery at a farmer's market, during the hours authorized for on-sale
of liquor in the jurisdiction where the farmer's market is located. Wine may only be provided
and consumed on the premises described in the license. A farm winery that conducts a
tasting under this subdivision must use any fees collected from participants in the tasting
only to defray the costs of conducting the tasting. The premises on which a tasting is
conducted must be insured as required by section 340A.409, subdivision 1.

new text begin (c) Nothing in this subdivision authorizes a farm winery to sell wine at off-sale at a
premises other than the premises allowed for off-sales under this section.

28A.151, and "tasting" has the meaning given in section 340A.419.
