A bill for an act
relating to education; providing for identification of students eligible for free meals
under the Community Eligibility Provision; requiring a report; proposing coding
for new law in Minnesota Statutes, chapter 124D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Department duties. new text end

new text begin (a) By April 1 of each year, the Department of
Education must identify schools and districts participating in the national school lunch
program that have an identified student percentage of 40 percent or higher under federal
guidelines for the Community Eligibility Provision.

new text begin (b) The department must communicate potential eligibility for the Community Eligibility
Provision to every participant and provide technical application assistance.

new text begin (c) The department must track whether a participant applies or declines to apply for the
Community Eligibility Provision.

new text begin By July 1 of each year, every potentially eligible participant
that declines to apply for federal resources from the Community Eligibility Provision must
report to the department the number of new students that could be served free meals under
the Community Eligibility Provision and the participant's specific reasons for declining
participation.

new text begin By January 1 of each year, the department must provide a report to
the chairs and ranking minority members of the legislative committees with jurisdiction
over kindergarten through grade 12 education that includes a list of potentially eligible
schools and districts that have not applied for federal resources from the Community
Eligibility Provision. The department must include in its report the reasons provided for
nonparticipation and the calculated amount of potential federal resources that have been
declined.
