A bill for an act
relating to public safety; providing law enforcement agencies with addresses of
individuals testing positive for COVID-19.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) As used in this section, the following terms have the
meanings given.

new text begin (b) "Fire department" has the meaning given in Minnesota Statutes, section 299F.092,
subdivision 6.

new text begin (c) "Firefighter" has the meaning given in Minnesota Statutes, section 299N.01,
subdivision 3.

new text begin (d) "Peace officer" has the meaning given in Minnesota Statutes, section 626.84,
subdivision 1, paragraph (c).

new text begin (e) "Peacetime public health emergency" means the peacetime emergency declared on
March 13, 2020, in Executive Order 20-01 and any extensions authorized under Minnesota
Statutes, section 12.31, subdivision 2.

new text begin (a) Notwithstanding Minnesota
Statutes, section 13.3805, during the peacetime public health emergency, the Department
of Health shall provide health data identifying the current address of any individual who
has tested positive for the COVID-19 virus to the chief law enforcement officer of the
political subdivision having jurisdiction over the address.

new text begin (b) In making the disclosure required under paragraph (a), the Department of Health
shall not disclose the name, age, date of birth, sex, or race of the individual who has tested
positive for the COVID-19 virus.

new text begin (a) Notwithstanding any law to the contrary, during the
peacetime public health emergency, a chief law enforcement officer may disclose the current
address of any individual who has tested positive for the COVID-19 virus to the fire chief
or administrative head of a fire department.

new text begin (b) Notwithstanding any law to the contrary, during the peacetime public health
emergency, a chief law enforcement officer or a fire chief or administrative head of a fire
department may disclose that a person at a particular address has tested positive for the
COVID-19 virus to a peace officer or firefighter dispatched to respond to a call for service
at that address.

new text begin (c) Except as provided in paragraphs (a) and (b), data received by a chief law enforcement
officer, fire chief or administrative head of a fire department, peace officer, or firefighter
that is private data retains its classification and can be used only for the purpose of responding
to a call for service in a manner that protects the health and safety of peace officers,
firefighters, and the community.
