A bill for an act
relating to human services; requiring the commissioner of human services to
conduct a prescription digital therapeutics pilot project; requiring a report;
appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PRESCRIPTION DIGITAL THERAPEUTICS PILOT PROJECT.

new text begin (a) The commissioner of human services must conduct a pilot project to explore the
effectiveness of prescription digital therapeutics (PDTs) in treating medical assistance
enrollees for substance use disorders and opioid use disorders. The pilot project must include
at least one clinic or practice site in the seven-county metropolitan area and at least one
clinic or practice site in greater Minnesota. The pilot project must allow the clinics or practice
sites to incorporate PDTs in the treatment plans for substance use disorders and opioid use
disorders for up to 12 weeks, in addition to treatment with medication and behavioral health
services, for up to 400 aggregate medical assistance enrollees. The enrollees participating
must reflect diverse population demographics. Participation by medical assistance enrollees
is voluntary. The participating clinics or practice sites must seek informed consent from
enrollees for participation in the pilot project, along with any necessary independent research
board approvals. The clinic or practice site must notify the commissioner of the enrollees
participating in the pilot project.

new text begin (b) The commissioner must submit a report on the pilot project to the chairs and ranking
minority members of the legislative committees with jurisdiction over health and human
services finance and policy by September 30, 2025. The report must:

new text begin (1) describe the characteristics of the population included in the pilot project;
new text end

new text begin (2) describe the successes and challenges of the pilot project;
new text end

new text begin (3) analyze the effect of the pilot project on access to treatment, patient satisfaction,
successful completion of treatment goals, and health equity;

new text begin (4) compare the hospitalization rates of the pilot population with that of medical assistance
enrollees with substance use disorders or opioid use disorders who did not utilize PDTs in
their treatment plans; and

new text begin (5) provide recommendations on whether PDT coverage for the treatment of substance
use disorders or opioid use disorders should be included under the medical assistance
program.

Sec. 2. new text begin APPROPRIATION.
new text end

new text begin $....... in fiscal year 2023 is appropriated from the general fund to the commissioner of
human services to establish and implement a prescription digital therapeutics pilot project
under section 1. The commissioner may use up to $....... of this appropriation for staffing
and administrative costs. Appropriated money may be expended until exhausted or through
January 1, 2025, whichever is earlier.
