A bill for an act
relating to insurance; changing the primary source of no-fault motor vehicle
insurance benefits for senior volunteer drivers; amending Minnesota Statutes
2004, section 65B.47, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2004, section 65B.47, is amended by adding a
subdivision to read:

(a) For purposes of this subdivision, "volunteer
driver" means an individual, age 60 years or older, who is using a motor vehicle to
transport persons or property for a governmental or nonprofit entity that uses volunteer
drivers to deliver meals; transport persons to medical, court, or other appointments;
transport furniture, clothing, food, or other items in connection with a food shelf,
distribution facility for used goods, or other use; or transport persons or property for any
other purpose of the governmental or nonprofit entity, at the request of that entity.

(b) In case of injury to a person who is acting as a volunteer driver, or to the
volunteer driver's spouse or other relative residing in the same household, when the injury
results from the maintenance or use of a motor vehicle, the security for payment of basic
economic loss benefits is the security covering a vehicle owned by the entity for which the
volunteer driver was driving, if the entity has a plan of reparation security that provides
coverage for its volunteer drivers under this subdivision, and if not, the security under
which the injured person is an insured.

(c) If the volunteer driver was maintaining or using a motor vehicle owned by the
entity for which the volunteer driver was driving, the plan of reparation security covering
that vehicle is the plan that is primary under paragraph (a). If the volunteer driver was
maintaining or using a vehicle not owned by the entity for which the volunteer driver was
driving, then any plan of reparation security covering any vehicle owned by the entity is
the plan that is primary under paragraph (a).
