A bill for an act
relating to environment; directing the governor to designate Minnesota Cleanup
Day; providing a minimum fine for littering; amending Minnesota Statutes 2004,
section 609.68; proposing coding for new law in Minnesota Statutes, chapter
115A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [115A.992] MINNESOTA CLEANUP DAY DESIGNATION.

new text begin The governor shall designate one day each year as Minnesota Cleanup Day and shall
encourage political subdivisions, civic organizations, nonprofit organizations, schools,
and private businesses to organize voluntary activities on that day to remove and lawfully
dispose of litter that has been deposited on the public and private lands and waters of
this state.

Sec. 2.

Minnesota Statutes 2004, section 609.68, is amended to read:

609.68 UNLAWFUL DEPOSIT OF GARBAGE, LITTER, OR LIKE.

Whoever unlawfully deposits garbage, rubbish, cigarette filters, debris from
fireworks, offal, or the body of a dead animal, or other litter in or upon any public highway,
public waters or the ice thereon, shoreland areas adjacent to rivers or streams as defined by
section 103F.205, public lands, or, without the consent of the owner, private lands or water
or ice thereon, is guilty of a petty misdemeanor new text begin and shall pay a fine of no less than $200 new text end .
