A bill for an act
relating to education; modifying requirements for test result reports; amending
Minnesota Statutes 2018, section 120B.30, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 120B.30, subdivision 3, is amended to read:


Subd. 3.

Reporting.

stakeholders, including the performance achievement levels developed from students'
unweighted test scores in each tested subject and a listing of demographic factors that
strongly correlate with student performance, including student homelessness, as data are
available, among other factors. The test results must not include personally identifiable
information as defined in Code of Federal Regulations, title 34, section 99.3. The

sites, school districts, Minnesota and other states, and Minnesota and other nations.

information to school districts within 30 days of receiving results. The test information must
include individual student performance history and

testing information that meets local needs for evaluating instruction and curriculum. The

than 30 days after receiving results. The results must include individual student performance
history and
new text end a deleted text begin moredeleted text end comprehensive report containing testing information that contains
anonymized data where cell count data are sufficient to protect student identity and that
meets the authorizer's needs in fulfilling its obligations under chapter 124E.

new text begin (c) A school district must disseminate the individual student performance data and
achievement report required under section 120B.30, subdivision 1a, paragraph (d), clause
(1), to the parent and teacher of each student no more than 30 days after the district receives
the information from the commissioner. The district must notify the parent and teacher that
the data and report are preliminary and subject to validation. The district must disseminate
the updated data and report to a teacher and parent only if the commissioner makes a
correction to the data and report after validation.

new text begin (d) A school district must disseminate a testing report to the teacher and to the parent
of each student before the beginning of the following school year. The testing report must:

new text begin (1) identify the student's achievement level in each content area; and
new text end

new text begin (2) track the student's performance history.

new text begin EFFECTIVE DATE. new text end

new text begin Paragraphs (a), (b), and (c), are effective for the 2021-2022 school
year and later. Paragraph (d) is effective for the 2022-2023 school year and later.
