A bill for an act
relating to environment; modifying requirements for burning refuse-derived
fuel in a solid waste fired boiler; amending Minnesota Statutes 2006, section
116.90, subdivision 1, by adding a subdivision; repealing Minnesota Statutes
2006, section 116.90, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 116.90, subdivision 1, is amended to read:


Subdivision 1.

Definitions.

(a) The definitions in this subdivision apply to this
section.

(b) "Agency" means the Pollution Control Agency.

(c) deleted text begin "Minor modification" means a physical or operational change that does not
increase the rated energy production capacity of a solid fuel fired boiler and which does
not involve capital costs in excess of 20 percent of a new solid fuel fired boiler having
the same rated capacity.

deleted text begin (d)deleted text end "Refuse-derived fuel" means a product resulting from the processing of mixed
municipal solid waste in a manner that reduces the quantity of noncombustible material
present in the waste, reduces the size of waste components through shredding or other
mechanical means, and produces a fuel suitable for combustion in existing or new solid
fuel fired boilers.

including but not limited to: wood, coal, biomass, or lignite to produce steam or heat water.

Sec. 2.

Minnesota Statutes 2006, section 116.90, is amended by adding a subdivision to
read:

new text begin Refuse-derived fuel use in solid fuel boilers. new text end

new text begin A person must not utilize
refuse-derived fuel in a solid fuel fired boiler unless the person complies with federal
requirements for burning refuse-derived fuel and:

new text begin (1) a permit is obtained from the agency for burning refuse-derived fuel; or
new text end

new text begin (2) the facility uses waste that is generated only from on-site operations.
