A bill for an act
relating to public safety; requiring the Police Officer Standards and Training Board
to develop a domestic violence policy for state and local law enforcement agencies;
proposing coding for new law in Minnesota Statutes, chapter 626.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) By October 15, 2018, the board shall develop
and distribute to all chief law enforcement officers a comprehensive model policy governing
procedures and strategies for addressing domestic violence prevention and acts of domestic
violence committed by peace officers and civilian employees of a state or local law
enforcement agency and high-profile persons including, at a minimum, elected officials,
high-level government appointees, media or sports figures, and entertainers. The board shall
convene a working group to develop the model policy. The working group shall include, at
a minimum, representatives of the board, the Minnesota Coalition of Battered Women, the
Minnesota Coalition Against Sexual Assault, the Minnesota Police and Peace Officers
Association, the Minnesota Sheriffs' Association, the Minnesota Chiefs of Police Association,
the Office of Crime Victim Services in the Minnesota Department of Public Safety, the
League of Minnesota Cities, the Association of Minnesota Counties, and the Minnesota
County Attorneys Association.

new text begin (b) The policy shall, at a minimum, include the following components:

new text begin (1) notification of a domestic violence incident to supervisory officer and chief law
enforcement officer;

new text begin (2) structured response to reported incidents of domestic violence with an emphasis on
victim safety;

new text begin (3) direction for conducting the subsequent administrative and criminal investigations;
new text end

new text begin (4) prevention of domestic violence through hiring and training practices of peace officers
and civilian employees of a state or local law enforcement agency;

new text begin (5) direction to supervisors for intervention when warning signs of domestic violence
involving peace officers and civilian employees of a state or local law enforcement agency
are evident;

new text begin (6) direction about peace officer duty weapon removal; and
new text end

new text begin (7) response to an incident involving a ranking law enforcement official or high-profile
person.

new text begin (a) By January 1, 2019, the chief law enforcement officer of
each state and local law enforcement agency must establish and enforce a written policy
governing domestic violence prevention and acts of domestic violence committed by peace
officers and civilian employees of a state or local law enforcement agency and high-profile
persons. The policy must, at a minimum, comply with the requirements of the model policy
adopted by the board under subdivision 1.

adopted a written policy in compliance with the board's model policy.
