A bill for an act
relating to transportation; requiring the commissioner to adopt rules for driver's
education programs and the driver's manual on safe interactions with law
enforcement officials and safely responding to emergencies; establishing the
Driver's Education Content Task Force; appropriating money; requiring rulemaking;
amending Minnesota Statutes 2016, sections 171.0701, subdivision 1; 171.0705,
by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2016, section 171.0701, subdivision 1, is amended to read:
Subdivision 1.
Driver education requirements.
(a) The commissioner shall adopt rules
requiring a minimum of 30 minutes of instruction, beginning January 1, 2007, relating to
organ and tissue donations and the provisions of section 171.07, subdivision 5, for persons
enrolled in driver education programs offered at public schools, private schools, and
commercial driver training schools.
(b) The commissioner shall adopt rules for persons enrolled in driver education programs
offered at public schools, private schools, and commercial driver training schools, requiring
inclusion in the course of instruction, by January 1, 2009, a section on awareness and safe
interaction with commercial motor vehicle traffic. The rules must require classroom
instruction and behind-the-wheel training that includes, but is not limited to, truck stopping
distances, proper distances for following trucks, identification of truck blind spots, and
avoidance of driving in truck blind spots.
(c) By January 1, 2012, the commissioner shall adopt rules for persons enrolled in driver
education programs offered at public schools, private schools, and commercial driver training
schools, requiring inclusion in the course of instruction of a section on carbon monoxide
poisoning. The instruction must include but is not limited to (1) a description of the
characteristics of carbon monoxide, (2) a review of the risks and potential speed of death
from carbon monoxide poisoning, and (3) specific suggestions regarding vehicle idling
practices.

(d) The commissioner must adopt rules requiring driver's education programs offered
at public schools, private schools, and commercial driver training schools to include
instruction on how to safely interact with law enforcement officials during traffic stops and
how drivers should safely respond to emergency situations related to operation of a vehicle.

Minnesota Statutes 2016, section 171.0705, is amended by adding a subdivision
to read:

each subsequent edition of the driver's manual published by the department a chapter on
how to safely interact with law enforcement officials during traffic stops and how drivers
should safely respond to emergency situations related to operation of a vehicle.

(a) A Driver's Education
Content Task Force is established to consider adding content to driver's education curriculum
and to the driver's manual on how to safely interact with law enforcement officials during
traffic stops and how drivers should safely respond to emergency situations related to
operation of a vehicle. The task force must:

(1) make recommendations on how to implement these changes;

new text begin
(2) propose content for addition to both driver's education curriculum and the driver's
manual; and
new text end
new text begin
(3) propose any legislation necessary to implement these changes.

(b) By February 15, 2019, the task force must submit a report to the chairs, ranking
minority members, and staff of the legislative committees with jurisdiction over transportation
policy and finance. The report must include the recommendations, proposed content, and
proposed legislation developed under paragraph (a).

The task force consists of the following members:

(1) two senators, including one senator appointed by the senate majority leader and one
senator appointed by the senate minority leader;

(2) two members of the house of representatives, including one member appointed by
the speaker of the house and one member appointed by the minority leader;

new text begin
(3) the commissioner of public safety or the commissioner's designee;
new text end
new text begin
(4) the chief of the State Patrol or the chief's designee;
new text end
new text begin
(5) one member appointed by the Sheriffs' Association;
new text end
new text begin
(6) one member appointed by the Minnesota Chiefs of Police Association;
new text end
new text begin
(7) one member appointed by the Minnesota Police and Peace Officers Association;

(8) one member appointed by the American Civil Liberties Union of Minnesota;

(9) one member appointed by the Peace Officer Standards and Training Board;

(10) one member appointed by the NAACP;
new text end
new text begin
(11) one member representing the councils of color, appointed by the director of the
Legislative Coordinating Commission;

(12) one member representing driving schools, appointed by the commissioner of public
safety;

(13) one member appointed by the Minneapolis Urban League; and

(14) one community member representing community concerns, appointed by the
governor.

(a) Each appointing entity under subdivision 2 must make
appointments by July 1, 2018.

(b) The commissioner of public safety must convene the initial meeting of the task force
no later than August 1, 2018. At the initial meeting, the members of the task force must
elect a chair or cochairs from among the task force members.

(c) The Legislative Coordinating Commission must provide meeting space, administrative
support, and staff support for the task force.

(d) Members of the task force serve without compensation or payment of expenses.

The task force under this section expires February 15, 2019, or the
day after the report required under subdivision 1, paragraph (b), is submitted, whichever is
earlier.

The commissioner must consider the task force report submitted under section 3 (1) as
a comment submitted in response to the request for comments for the rulemaking under
Minnesota Statutes, section 171.0701, subdivision 1, authorized under section 1, and (2)
during the next driver's manual revision under Minnesota Statutes, section 171.0705,
subdivision 11.
