A bill for an act
relating to transportation; governing implementation of compliance with the federal
REAL ID Act; eliminating certain background check requirements; amending
certain requirements on documentation of residence for driver's licenses and
Minnesota identification cards; appropriating money for Driver and Vehicle
Services temporary staffing; amending Minnesota Statutes 2018, sections 171.017,
subdivision 1; 171.0605, subdivision 5.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1.
Minnesota Statutes 2018, section 171.017, subdivision 1, is amended to read:
Subdivision 1.
Background checks authorized.
The commissioner must investigate
the criminal history background of any driver's license agent and any current or prospective
employees of the department or driver's license agent being considered for any position that
has or will have the ability to:
(1) create or modify records of applicants for deleted text begin identification cards and driver's licenses,
includingdeleted text end new text begin REAL ID compliant driver's licenses, REAL ID compliant identification cards,new text end
enhanced driver's licensesnew text begin ,new text end and enhanced identification cards;
(2) issue enhanced driver's licenses or enhanced identification cards; or
(3) administer knowledge or skills tests under section 171.13 to an applicant for a
commercial driver's license.

Sec. 2.
Minnesota Statutes 2018, section 171.0605, subdivision 5, is amended to read:
Subd. 5.
Evidence; residence in Minnesota.
new text begin (a) new text end Submission of two forms of
documentation from the following is satisfactory evidence of an applicant's principal
residence address in Minnesota under section 171.06, subdivision 3, paragraph (b):
(1) a home utility services bill issued no more than deleted text begin 90 daysdeleted text end new text begin 12 monthsnew text end before the
applicationdeleted text begin , provided that the commissioner must not accept a United States home utility
bill if two unrelated people are listed on the billdeleted text end ;

(8) a statement from a housing with services building registered under chapter 144D,
nursing home licensed under chapter 144A, or a boarding care facility licensed under sections

(9) a deleted text begin life,deleted text end new text begin current policy or card for new text end health, automobile, homeowner's, or renter's insurance

(10) a federal or state income tax return deleted text begin or statementdeleted text end for the most recent tax filing year;
(11) a Minnesota property tax statement for the currentnew text begin or prior calendarnew text end year new text begin or a
proposed Minnesota property tax notice for the current year new text end that shows the applicant's
principal residential address both on the mailing portion and the portion stating what property
is being taxed;
(12) a Minnesota vehicle certificate of titledeleted text begin , if issued no more than 12 months before the
applicationdeleted text end ;
(13) a filed property deed or title for current residencedeleted text begin , if issued no more than 12 months
before the applicationdeleted text end ;
(14) a Supplemental Security Income award statement issued no more than 12 months
before the application;
(15) mortgage documents for the applicant's principal residence;
(16) a residential lease agreement for the applicant's principal residence issued no more
than 12 months before the application;
(17) a valid driver's license, including an instruction permit, issued under this chapter;
(18) a valid Minnesota identification card;
(19) an unexpired Minnesota professional license;
(20) an unexpired Selective Service card; deleted text begin or

(22) a cellular phone bill issued no more than 12 months before the application; or

(23) a valid license issued pursuant to the game and fish laws.

(b) In lieu of one of the two documents required by paragraph (a), an applicant under
the age of 18 may use a parent or guardian's proof of principal residence as provided in this
paragraph. The parent or guardian of the applicant must provide a document listed under
paragraph (a) that includes the same address as the address on the document provided by
the applicant. The parent or guardian must also certify that the applicant is the child of the
parent or guardian and lives at that address.

Sec. 3. new text begin DRIVER AND VEHICLE SERVICES TEMPORARY STAFFING;
APPROPRIATION.

(a) $2,709,000 in fiscal year 2020 is appropriated from the vehicle services operating
account in the special revenue fund to the commissioner of public safety to temporarily
increase the customer service capacity of Driver and Vehicle Services related to drivers'
licenses and Minnesota identification cards. This appropriation is only for work performed
or expenses incurred on or before June 30, 2021. This appropriation must be spent to hire
temporary or contract employees and equipment and space for these employees. This
appropriation must not be spent for permanent state employees.

(b) During the period from initial implementation of the temporary staffing to December
31, 2020, the commissioner must make reasonable efforts to achieve a turnaround time of
not more than 45 days to issue drivers' licenses and Minnesota identification cards.

(c) This is a onetime appropriation and is available until June 30, 2021.
