A bill for an act
relating to capital investment; expanding review by commissioner of management
and budget of capital funding requests from political subdivisions; amending
Minnesota Statutes 2016, section 16A.86, subdivision 2, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 16A.86, subdivision 2, is amended to read:


Subd. 2.

Budget request.

A political subdivision that requests an appropriation of state
money for a local capital improvement project is encouraged to submit the request to the
commissioner of management and budget by July 15 of an odd-numbered year to ensure

Sec. 2.

Minnesota Statutes 2016, section 16A.86, is amended by adding a subdivision to
read:

new text begin The commissioner must evaluate each request from a political
subdivision to determine whether:

new text begin (1) the political subdivision has provided for the maximum possible nonstate funding
for the project;
new text end

new text begin (2) the project helps to fulfill an important state mission;
new text end

new text begin (3) the project is of regional or statewide significance;
new text end

new text begin (4) the project will expand the state's role into a new policy area;
new text end

new text begin (5) state funding for the project will create significant inequities among local jurisdictions;
and
new text end

new text begin (6) the project will compete with other facilities to the detriment of those other facilities.
