A bill for an act
relating to criminal justice; clarifying the professional licensing status of certain
tribal peace officers; amending Minnesota Statutes 2014, section 626.90,
subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 626.90, subdivision 3, is amended to read:


Subd. 3.

Peace officers.

new text begin (a) new text end If the band complies with the requirements set forth
in subdivision 2, the band is authorized to appoint peace officers, as defined in section
626.84, subdivision 1, paragraph (c), who have the same powers as peace officers
employed by local units of government.

new text begin (b) If the band complies with the requirements set forth in subdivision 2, paragraph
(a), but does not have a mutual aid/cooperative agreement in place with the Mille Lacs
County sheriff, the band may continue to appoint and employ peace officers. These
officers are considered to be appointed to a peace officer position and are eligible for
initial or continued licensing by the Board of Peace Officer Standards and Training. This
paragraph addresses these officers' professional licensing status only and may not be
interpreted as expanding or restricting the substantive law enforcement authority of the
band or its peace officers under other provisions of this section.
