  1.1                          A bill for an act
  1.2             relating to juveniles; appropriating money to juvenile 
  1.3             facilities that provide quality programming, as 
  1.4             demonstrated by measurable outcomes. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [JUVENILE PROGRAMMING GRANT PROGRAM.] 
  1.7      Subdivision 1.  [GRANT PROGRAM.] The commissioner of 
  1.8   corrections shall develop and administer a grant program to 
  1.9   provide grants to juvenile facilities that house juvenile 
  1.10  delinquents, juvenile petty offenders, or both.  The money 
  1.11  available through this grant program is intended to reward 
  1.12  facilities that provide quality programming, as demonstrated by 
  1.13  measurable outcomes, by making available to them additional 
  1.14  funds to enhance or expand their programming.  Facilities that 
  1.15  are currently state funded and facilities that are not state 
  1.16  funded are both eligible to compete for these grants. 
  1.17     Subd. 2.  [ELIGIBILITY CRITERIA.] The department of 
  1.18  corrections shall develop a grant application for facilities to 
  1.19  use in seeking grants under this section.  This grant 
  1.20  application shall require information on the following: 
  1.21     (1) the facility's recidivism rates, as determined by the 
  1.22  department of corrections' standards, when applicable; 
  1.23     (2) the educational progress made by juveniles while at the 
  1.24  facility, as determined by the department of corrections' 
  1.25  standards; and 
  2.1      (3) aftercare programming and other efforts toward 
  2.2   reunification of the juvenile with the family and community upon 
  2.3   release. 
  2.4      In awarding grants under this section, the commissioner of 
  2.5   corrections shall give priority to those facilities that have 
  2.6   achieved and sustained measurable outcomes, as demonstrated by 
  2.7   recidivism rates and educational achievement. 
  2.8      Subd. 3.  [STANDARDS.] The commissioner of corrections 
  2.9   shall identify and/or develop standards for facilities to use in 
  2.10  determining recidivism rates and educational progress. 
  2.11     Subd. 4.  [NONDISCRIMINATION.] For the purposes of this 
  2.12  section, no facility shall receive preferential treatment over 
  2.13  any other facility nor shall any facility be discriminated 
  2.14  against in any way, except on the basis of the eligibility 
  2.15  criteria established in subdivision 2. 
  2.16     Sec. 2.  [APPROPRIATION; DEPARTMENT OF CORRECTIONS.] 
  2.17     $....... is appropriated from the general fund to the 
  2.18  commissioner of corrections to develop and administer the grant 
  2.19  program established in section 1.  This appropriation is 
  2.20  available until June 30, 1999.
