A bill for an act
relating to education; modifying open enrollment transportation provisions;
amending Minnesota Statutes 2008, section 124D.03, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 124D.03, is amended by adding a
subdivision to read:

new text begin Recruitment and pupil transportation. new text end

new text begin A school district may not spend
more than one percent of its total annual operating expenditures on promotional materials,
advertising, or other materials designed to encourage nonresident students to attend its
schools. A nonresident district may transport a pupil within the pupil's resident district
under this section only with the approval of the resident district. If the resident district
denies approval, the parent or guardian of a pupil attending a nonresident district under
this section may appeal the denial to the commissioner of education, who must rule on
the appeal within 60 days of its receipt.
