  1.1                          A bill for an act
  1.2             relating to public safety; permitting sales and use of 
  1.3             fireworks under certain circumstances; proposing 
  1.4             coding for new law in Minnesota Statutes, chapter 624. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [624.215] [CERTAIN PERSONAL USE PERMITTED.] 
  1.7      Subdivision 1.  [GENERALLY.] Notwithstanding sections 
  1.8   624.20 to 624.25, personal use of fireworks and sales of 
  1.9   fireworks for personal use are permitted as provided by this 
  1.10  section.  This section applies only to fireworks classified as 
  1.11  class C explosives by the United States Department of 
  1.12  Transportation. 
  1.13     Subd. 2.  [PERMITTED DAYS.] Fireworks may be purchased, 
  1.14  used, possessed, or exploded for personal use only from July 1 
  1.15  through July 8 of any calendar year and from December 28 of any 
  1.16  calendar year through January 4 of the following calendar year. 
  1.17     Subd. 3.  [PERMITTED PURCHASE AND POSSESSION BY 
  1.18  NONRESIDENTS.] A person who is not a resident of the state of 
  1.19  Minnesota may purchase or possess fireworks, but shall not use 
  1.20  or explode fireworks except as permitted by subdivision 1. 
  1.21     Subd. 4.  [SALES PERMITTED.] A retail seller may sell 
  1.22  fireworks for personal use to a resident of Minnesota from June 
  1.23  1 through July 8 of any calendar year and from December 28 of 
  1.24  any calendar year through January 4 of the following calendar 
  1.25  year, and may sell fireworks for personal use to a person who is 
  2.1   not a resident of Minnesota at any time.  Fireworks held for 
  2.2   sale under authority of this section must carry a label warning 
  2.3   that personal use is permitted only from July 1 through July 8 
  2.4   under this section.  Anyone selling fireworks under authority of 
  2.5   this section must post in a conspicuous location the following 
  2.6   warning in block letters not less than one inch in height:  
  2.7   "FIREWORKS PURCHASED FOR PERSONAL USE UNDER MINNESOTA STATUTES, 
  2.8   SECTION 624.215, MAY BE USED OR EXPLODED IN MINNESOTA ONLY FROM 
  2.9   JULY 1 THROUGH JULY 8."
