  1.1                          A bill for an act
  1.2             relating to education; providing for student 
  1.3             scholarships and teacher stipends under the advanced 
  1.4             placement and international baccalaureate program; 
  1.5             amending Minnesota Statutes 1998, section 120B.13, by 
  1.6             adding subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 120B.13, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 3a.  [STUDENT SCHOLARSHIPS.] (a) In each year, to the 
  1.11  extent of available appropriations, the commissioner shall award 
  1.12  scholarships to students who: 
  1.13     (1) score three or better on one or more advanced placement 
  1.14  or international baccalaureate exams; and 
  1.15     (2) enroll in a Minnesota public or private college or 
  1.16  university.  The amount of each scholarship shall range between 
  1.17  $75 and $500 based on students' scores on the exams.  If the 
  1.18  total amount of the appropriation is inadequate, the 
  1.19  commissioner may pay less than the full scholarship amount. 
  1.20     (b) The total amount of each scholarship shall be paid 
  1.21  directly to the student's designated college or university and 
  1.22  must be used by the student only for tuition, required fees, and 
  1.23  books in nonsectarian courses or programs.  The commissioner and 
  1.24  the higher education services office jointly shall determine the 
  1.25  payment process, the amount of the scholarships, and the 
  1.26  provisions for unused scholarships. 
  2.1      (c) In order to be eligible to receive advanced placement 
  2.2   or international baccalaureate scholarships on behalf of the 
  2.3   qualifying students, the college or university must have an 
  2.4   advanced placement or international baccalaureate credit and 
  2.5   placement policy for the scholarship recipients.  In addition, 
  2.6   each college or university must certify these policies to the 
  2.7   commissioner each year.  The commissioner must provide each 
  2.8   secondary school in the state with a copy of the post-secondary 
  2.9   advanced placement and international baccalaureate policies each 
  2.10  year. 
  2.11     Sec. 2.  Minnesota Statutes 1998, section 120B.13, is 
  2.12  amended by adding a subdivision to read: 
  2.13     Subd. 3b.  [TEACHER STIPENDS.] (a) In each year, to the 
  2.14  extent of available appropriations, the commissioner shall award 
  2.15  stipends to teachers who teach an advanced placement or 
  2.16  international baccalaureate course.  Teachers shall receive a 
  2.17  stipend for each student in a teacher's course who receives a 
  2.18  three or better on the advanced placement or a four or better on 
  2.19  the international baccalaureate examination that covers the 
  2.20  subject matter of the course.  The commissioner shall determine 
  2.21  the payment process and the amount of the teacher stipend 
  2.22  ranging from $25 to $50 for each student receiving a qualifying 
  2.23  score. 
  2.24     (b) A stipend awarded to a teacher under this subdivision 
  2.25  shall not be a mandatory subject of bargaining under chapter 
  2.26  179A or any other law and shall not be a term or condition of 
  2.27  employment.  The amount of any award shall be final and shall 
  2.28  not be subject to review by an arbitrator through any grievance 
  2.29  or other process or by a court through any appeal process. 
  2.30     Sec. 3.  [EFFECTIVE DATE.] 
  2.31     Sections 1 and 2 are effective July 1, 2000.
