A bill for an act
relating to data practices; modifying treatment of presidential primary voter data;
amending Minnesota Statutes 2019 Supplement, section 201.091, subdivision 4a.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2019 Supplement, section 201.091, subdivision 4a, is
amended to read:


Subd. 4a.

Presidential primary political party list.

new text begin (a) new text end The secretary of state must
maintain a list of the voters who voted in a presidential nomination primary and the political
party each voter selected. Information maintained on the list is private data on individuals
as defined under section 13.02, subdivision 12, except that the secretary of state must provide
the list to the chair of each major political party.

new text begin (b) A chair of a major political party must not disseminate data on the list required to
be maintained under paragraph (a), except for uses related to elections and political activities
and only: (1) to persons designated by the chair of the major political party, or (2) to the
major political party's national committee.

new text begin (c) Any person who receives data from a chair of a major political party under paragraph
(b) must not disseminate the data maintained on the list.

new text begin (d) Any person who violates this subdivision is subject to the penalties and remedies in
sections 13.08 and 13.09.
