A bill for an act
relating to state government; appropriating money for public access automated
external defibrillators to be placed in state parks, public boat accesses, waysides,
and school districts; requiring reports.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin $23,796,000 in fiscal year 2023 is appropriated from
the general fund to the commissioners of natural resources, transportation, and education
to provide grants to Power to Save a Life, Inc., also known as Advocates for Health, Inc.,
a nonprofit corporation, to purchase and install on public land public access AEDs, defined
in Minnesota Statutes, section 403.51, subdivision 1. This is a onetime appropriation and
must be allocated as follows:

new text begin (1) $....... to the commissioner of natural resources for three AEDs at each state park
and ten AEDs in public boat accesses maintained by the commissioner in each county;

new text begin (2) $....... to the commissioner of transportation to place one AED at each Class I, Class
II, and Class III safety rest area; each travel information center; each regional welcome
center operated by the commissioner or in partnership with others; and each visitor center
operated in partnership with the commissioner of natural resources; and

new text begin (3) $....... to the commissioner of education for two AEDs for each school district.

new text begin Grant limitations. new text end

new text begin A grant under this section must be used to purchase, install,
and operate public access AEDs and is subject to the following limitations:

new text begin (1) each AED purchased with a grant under this section must be located outdoors or in
an indoor facility that is always publicly accessible;
new text end

new text begin (2) the local, state, or federal agency that administers the land on which the AED will
be located must agree to the specific location where the AED will be placed;
new text end

new text begin (3) the grant recipient must agree to provide for the operation and maintenance of the
AED for at least eight years from installation without seeking additional state or local
funding;

new text begin (4) the grant recipient must agree to install, operate, and maintain the AED in a manner
that accounts for typical weather and temperature conditions and ensures reliable operation
in those conditions; and

new text begin (5) the grant recipient must comply with all applicable requirements of Minnesota
Statutes, section 403.51.

new text begin Within 90 days of the effective date of this section, each agency
named in subdivision 1 must begin accepting and acting upon applications from the grant
recipient for installation of AEDs on the properties described in subdivision 1.

new text begin By October 1, 2023, each agency named in subdivision 1 must
report to the chairs and ranking minority members of the legislative committees and divisions
with jurisdiction over the agency on the administration of grants provided under this section.
