  1.1                          A bill for an act
  1.2             relating to education; including a licensed community 
  1.3             education instructor in the definition of teacher upon 
  1.4             mutual agreement of a school board and the exclusive 
  1.5             bargaining representative of the teachers; amending 
  1.6             Minnesota Statutes 1996, section 125.032, subdivision 
  1.7             2. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 125.032, 
  1.10  subdivision 2, is amended to read: 
  1.11     Subd. 2.  [EXCEPTIONS.] A person who teaches in a community 
  1.12  education program which qualifies for aid pursuant to section 
  1.13  124.26 shall continue to meet licensure requirements as a 
  1.14  teacher.  A person who teaches in an early childhood and family 
  1.15  education program which is offered through a community education 
  1.16  program and which qualifies for community education aid pursuant 
  1.17  to section 124.2713 or early childhood and family education aid 
  1.18  pursuant to section 124.2711 shall continue to meet licensure 
  1.19  requirements as a teacher.  A person who teaches in a community 
  1.20  education course which is offered for credit for graduation to 
  1.21  persons under 18 years of age shall continue to meet licensure 
  1.22  requirements as a teacher.  A person who teaches a driver 
  1.23  training course which is offered through a community education 
  1.24  program to persons under 18 years of age shall be licensed by 
  1.25  the board of teaching or be subject to section 171.35.  A 
  1.26  license which is required for an instructor in a community 
  2.1   education program pursuant to this subdivision shall not be 
  2.2   construed to bring an individual within the definition of a 
  2.3   teacher for purposes of section 125.12, subdivision 1, or 
  2.4   125.17, subdivision 1, clause (a), except by written agreement 
  2.5   between the school board and the exclusive bargaining 
  2.6   representative of the teachers.  
  2.7      Sec. 2.  [EFFECTIVE DATE.] 
  2.8      Section 1 is effective July 1, 1998.
