  1.1                             A resolution
  1.2             urging the Congress of the United States to repeal a 
  1.3             provision of federal law that requires each state to 
  1.4             record the social security number of a citizen on an 
  1.5             application for a driver's license for the state to 
  1.6             receive certain federal funding. 
  1.7      
  1.8      WHEREAS, Congress has amended the provisions of the 
  1.9   Personal Responsibility and Work Opportunity Reconciliation Act 
  1.10  of 1996, United States Code, title 42, section 666, subsection 
  1.11  (a), paragraph (13), subparagraph (A), effective October 1, 
  1.12  2000, concerning the identification of parents who are 
  1.13  delinquent in child support payments; and 
  1.14     WHEREAS, for a state to be eligible to receive certain 
  1.15  federal funding, the amendments to United States Code, title 42, 
  1.16  section 666, subsection (a), paragraph (13), subparagraph (A), 
  1.17  require the state to have in place certain procedures to record 
  1.18  the social security number of a citizen on an application for a 
  1.19  driver's license; and 
  1.20     WHEREAS, the provisions are intended to aid in the 
  1.21  identification of parents who are delinquent in child support 
  1.22  payments; however, the provisions apply to each person who 
  1.23  applies for a driver's license, whether or not the person is 
  1.24  delinquent in child support payments; and 
  1.25     WHEREAS, the provisions violate the fundamental principle 
  1.26  of states' rights recognized by the Tenth Amendment to the 
  2.1   Constitution of the United States of America by infringing on 
  2.2   the states' traditional right to regulate matters of family law; 
  2.3   and 
  2.4      WHEREAS, the provisions violate the fundamental right of 
  2.5   law-abiding citizens to be secure from unreasonable government 
  2.6   intrusion, surveillance, and monitoring; and 
  2.7      WHEREAS, the federal government often uses social security 
  2.8   numbers to collect personal, family, financial, and medical 
  2.9   information of law-abiding citizens without their knowledge or 
  2.10  consent; and 
  2.11     WHEREAS, the collection of such personal information is 
  2.12  increasing, and the opportunity for the federal government to 
  2.13  abuse that information violates the fundamental right of 
  2.14  law-abiding citizens to be free from unreasonable government 
  2.15  intrusion, surveillance, and monitoring; and 
  2.16     WHEREAS, the widespread use of social security numbers has 
  2.17  contributed to the increasing incidence of identity theft and 
  2.18  has left law-abiding citizens vulnerable to persons and business 
  2.19  organizations who unlawfully use the personal information of 
  2.20  citizens without their knowledge or consent; and 
  2.21     WHEREAS, the provisions have received criticism from other 
  2.22  states, including Michigan, where the secretary of state has 
  2.23  filed an action in a United States District Court to enjoin the 
  2.24  enforcement of the provisions; and 
  2.25     WHEREAS, the collection of social security numbers from 
  2.26  law-abiding citizens causes state and local governments to 
  2.27  violate the fundamental right of citizens to be secure from 
  2.28  unreasonable government intrusion, surveillance, and monitoring; 
  2.29  NOW, THEREFORE, 
  2.30     BE IT RESOLVED by the Legislature of the State of Minnesota 
  2.31  that it expresses strong disapproval of the provisions of United 
  2.32  States Code, title 42, section 666, subsection (a), paragraph 
  2.33  (13), subparagraph (A), which require each state to have in 
  2.34  place procedures to record the social security number of a 
  2.35  citizen on an application for a driver's license. 
  2.36     BE IT FURTHER RESOLVED that the members of the Minnesota 
  3.1   Legislature respectfully urge the Congress of the United States 
  3.2   to repeal those provisions of United States Code, title 42, 
  3.3   section 666, subsection (a), paragraph (13), subparagraph (A). 
  3.4      BE IT FURTHER RESOLVED that the Secretary of State of the 
  3.5   State of Minnesota is directed to prepare copies of this 
  3.6   memorial and transmit them to the President of the United 
  3.7   States, President and Secretary of the United States Senate, the 
  3.8   Speaker and Clerk of the United States House of Representatives, 
  3.9   and Minnesota's Senators and Representatives in Congress.
