  1.1                          A bill for an act 
  1.2             relating to state government; establishing the salary 
  1.3             for the lieutenant governor and the attorney general; 
  1.4             amending Minnesota Statutes 1998, section 15A.082, 
  1.5             subdivisions 1, 3, and 4a; proposing coding for new 
  1.6             law in Minnesota Statutes, chapter 15A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 15A.082, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [CREATION.] A compensation council is 
  1.11  created each even-numbered year to assist the legislature in 
  1.12  establishing the compensation of constitutional officers the 
  1.13  governor, state auditor, members of the legislature, justices of 
  1.14  the supreme court, judges of the court of appeals and district 
  1.15  court, and the heads of state and metropolitan agencies included 
  1.16  in section 15A.0815. 
  1.17     Sec. 2.  Minnesota Statutes 1998, section 15A.082, 
  1.18  subdivision 3, is amended to read: 
  1.19     Subd. 3.  [SUBMISSION OF RECOMMENDATIONS.] (a) By May 1 in 
  1.20  each odd-numbered year, the compensation council shall submit to 
  1.21  the speaker of the house of representatives and the president of 
  1.22  the senate salary recommendations for constitutional 
  1.23  officers the governor, state auditor, legislators, justices of 
  1.24  the supreme court, and judges of the court of appeals and 
  1.25  district court.  The recommended salary for each office must 
  1.26  take effect on the first Monday in January of the next 
  2.1   odd-numbered year, with no more than one adjustment, to take 
  2.2   effect on January 1 of the year after that.  The salary 
  2.3   recommendations for legislators, judges, the governor, and 
  2.4   constitutional officers state auditor take effect if an 
  2.5   appropriation of money to pay the recommended salaries is 
  2.6   enacted after the recommendations are submitted and before their 
  2.7   effective date.  Recommendations may be expressly modified or 
  2.8   rejected.  The salary recommendations for legislators are 
  2.9   subject to additional terms that may be adopted according to 
  2.10  section 3.099, subdivisions 1 and 3. 
  2.11     (b) The council shall also submit to the speaker of the 
  2.12  house of representatives and the president of the senate 
  2.13  recommendations for the salary ranges of the heads of state and 
  2.14  metropolitan agencies, to be effective retroactively from 
  2.15  January 1 of that year if enacted into law.  The recommendations 
  2.16  shall include the appropriate group in section 15A.0815 to which 
  2.17  each agency head should be assigned and the appropriate 
  2.18  limitation on the maximum range of the salaries of the agency 
  2.19  heads in each group, expressed as a percentage of the salary of 
  2.20  the governor. 
  2.21     Sec. 3.  Minnesota Statutes 1998, section 15A.082, 
  2.22  subdivision 4a, is amended to read: 
  2.23     Subd. 4a.  [CONSTITUTIONAL OFFICERS.] No constitutional 
  2.24  officer whose compensation is set under this section or section 
  2.25  15A.0825 may receive monetary compensation for unused vacation 
  2.26  or sick leave accruals. 
  2.27     Sec. 4.  [15A.0825] [LIEUTENANT GOVERNOR AND ATTORNEY 
  2.28  GENERAL.] 
  2.29     The salary of the lieutenant governor is 90 percent of the 
  2.30  salary of the governor.  The salary of the attorney general is 
  2.31  90 percent of the salary of the governor.
