  1.2             relating to education; increasing referendum 
  1.3             equalization aid; amending Minnesota Statutes 2001 
  1.4             Supplement, section 126C.17, subdivision 5. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2001 Supplement, section 
  1.7   126C.17, subdivision 5, is amended to read: 
  1.8      Subd. 5.  [REFERENDUM EQUALIZATION REVENUE.] (a) For fiscal 
  1.9   year 2003 and later, A district's referendum equalization 
  1.10  revenue equals the sum of the first tier referendum equalization 
  1.11  revenue and the second tier referendum equalization revenue. 
  1.12     (b) A district's first tier referendum equalization revenue 
  1.13  equals the district's first tier referendum equalization 
  1.14  allowance times the district's resident marginal cost pupil 
  1.15  units for that year.  
  1.16     (c) A district's first tier referendum equalization 
  1.17  allowance equals the lesser of the district's referendum 
  1.18  allowance under subdivision 1 or $126 $230. 
  1.19     (d) A district's second tier referendum equalization 
  1.20  revenue equals the district's second tier referendum 
  1.21  equalization allowance times the district's resident marginal 
  1.22  cost pupil units for that year. 
  1.23     (e) A district's second tier referendum equalization 
  1.24  allowance equals the lesser of the district's referendum 
  1.25  allowance under subdivision 1 or 18.2 percent of the formula 
  2.1   allowance, minus the district's first tier referendum 
  2.2   equalization allowance. 
  2.3      (f) Notwithstanding paragraph (e), the second tier 
  2.4   referendum allowance for a district qualifying for secondary 
  2.5   sparsity revenue under section 126C.10, subdivision 7, or 
  2.6   elementary sparsity revenue under section 126C.10, subdivision 
  2.7   8, equals the district's referendum allowance under subdivision 
  2.8   1 minus the district's first tier referendum equalization 
  2.9   allowance. 
  2.10     [EFFECTIVE DATE.] This section is effective for revenue for 
  2.11  fiscal year 2004.
