  1.1                          A bill for an act 
  1.2             relating to taxation; providing an income tax credit 
  1.3             for collectors of used motor oil and used motor oil 
  1.4             filters; amending Minnesota Statutes 1996, section 
  1.5             290.06, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 290.06, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 26.  [COLLECTORS OF USED MOTOR OIL.] A person who 
  1.10  accepts used motor oil and used motor oil filters as defined in 
  1.11  section 325E.11, subdivisions 3 and 5, from the public may take 
  1.12  a credit against the tax liability under this chapter of $250 
  1.13  for any taxable year during which the taxpayer operates a 
  1.14  facility that qualifies for the reimbursement under section 
  1.15  325E.112, subdivision 2, or would qualify for the reimbursement 
  1.16  except that it does not accept contaminated motor oil.  In order 
  1.17  to claim the credit, the taxpayer must provide the commissioner 
  1.18  with a copy of a credit certificate issued to the taxpayer by 
  1.19  the commissioner of the pollution control agency verifying the 
  1.20  taxpayer's eligibility for this credit.  The commissioner of the 
  1.21  pollution control agency may issue no more than 200 certificates 
  1.22  for any calendar year. 
  1.23     Sec. 2.  [EFFECTIVE DATE.] 
  1.24     Section 1 is effective for taxable years beginning after 
  1.25  December 31, 1997.
