A bill for an act
 relating to human services; requiring the commissioner of human services to apply
for a federal waiver to provide nutrition supports as a covered service under medical
assistance.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DIRECTION TO COMMISSIONER OF HUMAN SERVICES; FOOD
INSECURITY 1115 DEMONSTRATION WAIVER.

new text begin The commissioner of human services shall apply to the secretary of health and human
services for a section 1115 demonstration waiver to provide, as a covered service under
medical assistance, medically appropriate nutrition supports to individuals with a documented
need for nutrition supports in their care plan or medical record and whose nutritional needs
are not being met by other food support programs. Nutrition supports may include nutrition
counseling and education, including counseling and education on healthy meal preparation;
medically tailored home-delivered meals; home-delivered meals or pantry stocking for
children and pregnant individuals; and fruit, vegetable, and protein prescriptions.
