  1.2             relating to health; eliminating the tobacco use 
  1.3             prevention and local public health endowment fund; 
  1.4             amending Minnesota Statutes 2000, section 144.395, 
  1.5             subdivision 3; Minnesota Statutes 2001 Supplement, 
  1.6             section 16A.87, subdivision 3; repealing Minnesota 
  1.7             Statutes 2000, sections 144.395, as amended; 144.396. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [PURPOSE.] 
  1.10     The tobacco use prevention and local public health 
  1.11  endowment fund is being repealed, and the money in the fund 
  1.12  transferred to the general fund, to aid in addressing the 
  1.13  state's budget deficit for fiscal years 2002 and 2003. 
  1.14     Sec. 2.  Minnesota Statutes 2001 Supplement, section 
  1.15  16A.87, subdivision 3, is amended to read: 
  1.16     Subd. 3.  [APPROPRIATION.] (a) Of the amounts credited to 
  1.17  the fund prior to January 2, 2002, 61 percent is appropriated 
  1.18  for transfer to the tobacco use prevention and local public 
  1.19  health endowment fund created formerly codified in section 
  1.20  144.395 and 39 percent is appropriated for transfer to the 
  1.21  medical education endowment fund created in section 62J.694. 
  1.22     (b) The entire amount credited to the fund from the payment 
  1.23  made on January 2, 2002, and January 2, 2003, is appropriated 
  1.24  for transfer to the academic health center account under section 
  1.25  62J.694, subdivision 1, paragraph (b), in the medical education 
  1.26  endowment fund created under section 62J.694, subdivision 1. 
  2.1      Sec. 3.  Minnesota Statutes 2000, section 144.395, 
  2.2   subdivision 3, is amended to read: 
  2.3      Subd. 3.  [SUNSET.] The tobacco use prevention and local 
  2.4   public health endowment fund expires June 30, 2015 2002.  Upon 
  2.5   expiration, the commissioner of finance shall transfer the 
  2.6   principal and any remaining interest to the general fund.  
  2.7      Sec. 4.  [REPEALER.] 
  2.8      Minnesota Statutes 2000, sections 144.395, as amended by 
  2.9   Laws 2001, First Special Session chapter 9, article 1, section 
  2.10  36; and 144.396, are repealed effective July 1, 2002. 
  2.11     Sec. 5.  [EFFECTIVE DATE.] 
  2.12     Sections 1 and 3 are effective the day following final 
  2.13  enactment.  Section 2 is effective July 1, 2002.
