1.1 A bill for an act 1.2 relating to workers' compensation; correcting an 1.3 appropriation error; modifying reporting requirements; 1.4 eliminating certain reimbursement requirements; 1.5 amending Minnesota Statutes 1996, sections 176.183, 1.6 subdivision 2; 176.231, subdivisions 2 and 7; and 1.7 176.305, subdivisions 1 and 2; Laws 1997, chapter 200, 1.8 article 1, section 12, subdivision 5. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 1996, section 176.183, 1.11 subdivision 2, is amended to read: 1.12 Subd. 2. After a hearing on a petition for benefits and 1.13 prior to issuing an order against the special compensation fund 1.14 to pay compensation benefits to an employee, a compensation 1.15 judge shall first make findings regarding the insurance status 1.16 of the employer and its liability. The special compensation 1.17 fund shall not be found liable in the absence of a finding of 1.18 liability against the employer. Where the liable employer is 1.19 found after the hearing to be not insured or self-insured as 1.20 provided for in this chapter, the compensation judge shall 1.21 assess and order the employer to pay all compensation benefits 1.22 to which the employee is entitled, the amount for actual and 1.23 necessary disbursements expended by the special compensation 1.24 fund, and a penalty in the amount of 65 percent of all 1.25 compensation benefits ordered to be paid. The award issued 1.26 against an employer after the hearing shall constitute a lien 1.27 for government services pursuant to section 514.67 on all 2.1 property of the employer and shall be subject to the provisions 2.2 of the revenue recapture act in chapter 270A. The special 2.3 compensation fund may enforce the terms of that award in the 2.4 same manner as a district court judgment. The commissioner of 2.5 labor and industry, in accordance with the terms of the order 2.6 awarding compensation, shall pay compensation to the employee or 2.7 the employee's dependent from the special compensation fund. 2.8 The commissioner of labor and industry shall certify to the 2.9 commissioner of finance and to the legislature annually the 2.10 total amount of compensation paid from the special compensation 2.11 fund under subdivision 1.The commissioner of finance shall2.12upon proper certification reimburse the special compensation2.13fund from the general fund appropriation provided for this2.14purpose. The amount reimbursed shall be limited to the2.15certified amount paid under this section or the appropriation2.16made for this purpose, whichever is the lesser amount.2.17 Compensation paid under this sectionwhich is not reimbursed by2.18the general fundshall remain a liability of the special 2.19 compensation fund and shall be financed by the percentage 2.20 assessed under section 176.129. 2.21 Sec. 2. Minnesota Statutes 1996, section 176.231, 2.22 subdivision 2, is amended to read: 2.23 Subd. 2. [INITIAL REPORT, WRITTEN REPORT.] Where 2.24 subdivision 1 requires an injury to be reported within 48 hours, 2.25 the employer may make an initial report by telephone, telegraph, 2.26 or personal notice, and file a written report of the injury 2.27 within seven days from its occurrence or within such time as the 2.28 commissioner of labor and industry designates. All written 2.29 reports of injuries required by subdivision 1 shall include the 2.30 date of injury, amounts of payments made, if any, and the date 2.31 of the first payment. The reports shall be on a form designed 2.32 by the commissioner, withthe originala clear copy suitable for 2.33 imaging to the commissioner, one copy to the insurer, and one 2.34 copy to the employee. 2.35 If an insurer or self-insurer repeatedly fails to pay 2.36 benefits within three days of the due date, pursuant to section 3.1 176.221, the insurer or self-insurer shall be ordered by the 3.2 commissioner to explain, in person, the failure to pay benefits 3.3 due in a reasonable time. If prompt payments are not thereafter 3.4 made, the commissioner shall refer the insurer or self-insurer 3.5 to the commissioner of commerce for action pursuant to section 3.6 176.225, subdivision 4. 3.7 Sec. 3. Minnesota Statutes 1996, section 176.231, 3.8 subdivision 7, is amended to read: 3.9 Subd. 7. [MEDICAL REPORTS.] If requested by the division, 3.10 a compensation judge, the workers' compensation court of 3.11 appeals, or any member or employee thereof an employer, insurer, 3.12 or employee shall file with the commissionerthe original ora 3.13 verified copy suitable for imaging of any medical report in 3.14 possession which bears upon the case and shall also file a 3.15 verified copy of the same report with the agency or individual 3.16 who made the request. 3.17 Sec. 4. Minnesota Statutes 1996, section 176.305, 3.18 subdivision 1, is amended to read: 3.19 Subdivision 1. [HEARINGS ON PETITIONS.] The petitioner 3.20 shall serve a copy of the petition on each adverse party 3.21 personally or by first class mail.The original petitionA 3.22 clear copy suitable for imaging shallthenbe filed with the 3.23 commissioner together with an appropriate affidavit of service. 3.24 When any petition has been filed with the workers' compensation 3.25 division, the commissioner shall, within ten days, refer the 3.26 matter presented by the petition for a settlement conference 3.27 under this section, for an administrative conference under 3.28 section 176.106, or for hearing to the office. 3.29 Sec. 5. Minnesota Statutes 1996, section 176.305, 3.30 subdivision 2, is amended to read: 3.31 Subd. 2. [COPY OF PETITION.] The commissioner shall 3.32 deliver theoriginalpetition and answer, after certification 3.33 for a hearing, to the office of administrative hearings for 3.34 assignment to a compensation judge. 3.35 Sec. 6. Laws 1997, chapter 200, article 1, section 12, 3.36 subdivision 5, is amended to read: 4.1 Subd. 5. Daedalus Project 4.2$2,500,000$2,800,000 appropriated in 4.3Laws 1995, chapter 224, section 12,4.4subdivision 2Laws 1996, chapter 452, 4.5 section 8, from the workers' 4.6 compensation fund for the Daedalus 4.7 imaging project does not cancel on June 4.8 30, 1997, but is available until June 4.9 30, 1999. 4.10 Sec. 7. [INSTRUCTION TO REVISOR.] 4.11 The revisor of statutes shall change the phrase "the 4.12 original" to "one clear copy suitable for imaging" in Minnesota 4.13 Rules, parts 5217.0800, subparts 1 and 2; 5218.0100, subpart 1, 4.14 item A; and 5220.2680, subparts 5 and 6. 4.15 The revisor of statutes shall change the phrase "The 4.16 original" to "One clean copy suitable for imaging of the" in 4.17 Minnesota Rules, part 5220.2690, subpart 3, item C.
