A bill for an act
relating to human services; establishing payment rates for home health agency
services and home care nursing services; amending Minnesota Statutes 2018,
sections 256B.0653, by adding a subdivision; 256B.0654, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 256B.0653, is amended by adding a subdivision
to read:

new text begin Payment rates for home health agency services. new text end

new text begin (a) For purposes of this
subdivision only, the following terms have the meanings given them:

new text begin (1) "base rate" means the most recent Medicare reimbursement rate, as modified by the
low utilization payment adjustment, for an individual Medicare service provided in Hennepin
County;
new text end

new text begin (2) "code" refers to a health care procedure code for a Medicare service published in
Healthcare Common Procedure Coding System Level II;
new text end

new text begin (3) "payment rate" means the reimbursement rate to an eligible provider for authorized
covered services provided to a qualified individual; and
new text end

new text begin (4) "unit of service" means a visit.
new text end

new text begin (b) On July 1 of each year, the commissioner must update the payment rates established
in clauses (1) to (9) to reflect the most recent base rate.

new text begin (1) The payment rate for a unit of service of a home health aide is the product of the
base rate for code G0156, services of a home health aide under a home health plan of care,
multiplied by 0.7948.

new text begin (2) The payment rate for a unit of service of occupational therapy is the product of the
base rate for code G0152, services performed by a qualified occupational therapist in the
home health or hospice setting, multiplied by 0.4488.

new text begin (3) The payment rate for a unit of service of occupational therapy assistant is the product
of the base rate for code G0158, services performed by a qualified occupational therapist
assistant in the home health or hospice setting, multiplied by 0.2879.

new text begin (4) The payment rate for a unit of service of physical therapy is the product of the base
rate for code G0151, services performed by a qualified physical therapist in the home health
or hospice setting, multiplied by 0.4429.

new text begin (5) The payment rate for a unit of service of physical therapy assistant is the product of
the base rate for code G0157, services performed by a qualified physical therapist assistant
in the home health or hospice setting, multiplied by 0.2879.

new text begin (6) The payment rate for a unit of service of respiratory therapy is the product of the
base rate for code G0153, services performed by a qualified speech-language pathologist
in the home health or hospice setting, multiplied by 0.2617.

new text begin (7) The payment rate for a skilled nursing visit is the product of the base rate for code
G0299, direct skilled nursing services of a registered nurse in the home health or hospice
setting, multiplied by 0.4690.

new text begin (8) The payment rate for a telehomecare skilled nursing visit is the product of the base
rate for code G0299, direct skilled nursing services of a registered nurse in the home health
or hospice setting, multiplied by 0.4690.

new text begin (9) The payment rate for speech therapy is the product of the base rate for code G0153,
services performed by a qualified speech-language pathologist in the home health or hospice
setting, multiplied by 0.4136.

2020.

Sec. 2.

Minnesota Statutes 2018, section 256B.0654, is amended by adding a subdivision
to read:

new text begin (a) For purposes of this subdivision
only, the following terms have the meanings given them:

new text begin (1) "base rate" means the most recent Medicare reimbursement rate, as modified by the
low utilization payment adjustment, for an individual Medicare service provided in Hennepin
County;

new text begin (2) "code" refers to a health care procedure code for a Medicare service published in
Healthcare Common Procedure Coding System Level II;

product of the base rate for code G0299, direct skilled nursing services of a registered nurse
in the home health or hospice setting, multiplied by 0.0418.

new text begin (2) The payment rate for complex home care nursing provided by a licensed practical
nurse is the product of the base rate for code G0299, direct skilled nursing services of a
registered nurse in the home health or hospice setting, multiplied by 0.0490.

new text begin (3) The payment rate for shared home care nursing provided by a licensed practical nurse
is the product of the base rate for code G0299, direct skilled nursing services of a registered
nurse in the home health or hospice setting, multiplied by 0.0314.

new text begin (4) The payment rate for home care nursing provided by a registered nurse is the product
of the base rate for code G0299, direct skilled nursing services of a registered nurse in the
home health or hospice setting, multiplied by 0.0545.

new text begin (5) The payment rate for complex home care nursing provided by a registered nurse is
the product of the base rate for code G0299, direct skilled nursing services of a registered
nurse in the home health or hospice setting, multiplied by 0.0653.

new text begin (6) The payment rate for shared home care nursing provided by a registered nurse is the
product of the base rate for code G0299, direct skilled nursing services of a registered nurse
in the home health or hospice setting, multiplied by 0.0408.
