A bill for an act
relating to health care; providing a onetime payment to medical assistance dental
providers to assist in covering the cost of personal protection equipment used when
providing dental services to medical assistance enrollees during the COVID
pandemic; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin PAYMENTS TO MEDICAL ASSISTANCE DENTAL PROVIDERS FOR
PERSONAL PROTECTIVE EQUIPMENT DURING THE COVID-19 PANDEMIC;

new text begin (a) For purposes of this section, the following terms have
the meanings given.

new text begin (b) "Commissioner" means the commissioner of human services.

new text begin (c)" Eligible provider" means a dentist or dental clinic that:

new text begin (1) accepts patients who are covered by medical assistance;
new text end

new text begin (2) is actively enrolled as a medical assistance provider on September 15, 2020;
new text end

new text begin (3) is located in Minnesota;
new text end

new text begin (4) is not paid on a cost-based payment system; and
new text end

new text begin (5) has received at least $5,000 in medical assistance payments from claims with a date
of service on or after October 1, 2019 through April 1,2020.

new text begin (d) "Medical assistance payments" means payments received for providing dental services
to medical assistance enrollees from claims submitted to either the commissioner or to a
managed care plan or county based purchasing plan, or to the plan's subcontractor.

new text begin (a) By October 15, 2020, the commissioner shall pay a onetime
payment to each eligible provider for the purpose of assisting in the increased costs incurred
by the provider for personal protective equipment used by the provider when performing
services during the COVID-19 pandemic. Any dentist or dental clinic that accepts a payment
under this section attests, by accepting the payment, that the dentist or dental clinic has
unreimbursable costs incurred on or after March 1, 2020, that are related to the purchase of
personal protective equipment due to the COVID-19 pandemic, and are greater than the
payment received.

new text begin (b) The payment to each eligible provider shall be based on a distribution formula
established by the commissioner within the amount of the appropriation and the requirements
of this section. The payment amount to be distributed to each eligible provider shall be
based on the number of historical claims paid to the provider with a date of service on or
after October 1, 2019, to April 1, 2020. The distribution formula shall use a fixed dollar
amount to be determined by the commissioner not to exceed $10 per claim. The commissioner
shall only consider claims that the commissioner receives before August 1, 2020, for purposes
of establishing the distribution formula.

new text begin (c) Notwithstanding paragraph (a), if a dentist or dental clinic meets the criteria in
subdivision 1, paragraph (c), clauses (1) through (4), but enrolled as a medical assistance
provider after October 1, 2019, the commissioner may calculate a payment using an
alternative formula for the dentist or dental clinic.

new text begin (d) Any dentist or dental clinic that accepts a payment under this section must agree to
continue to accept patients covered by medical assistance until December 30, 2020. If a
dentist or dental clinic receives a payment under this section but fails to meet this
requirement, the dentist or dental clinic must return the payment that the dentist or dental
clinic received to the commissioner within 30 days of disenrollment as a medical assistance
provider. The commissioner shall deposit any money that the commissioner receives under
this paragraph to the coronavirus relief fund.

new text begin Appropriation. new text end

new text begin $5,000,000 is appropriated in fiscal year 2021 from the
coronavirus relief fund to the commissioner of human services for the payments authorized
in this section. The total amount of payments paid under this section must not exceed the
amount appropriated. If based on the distribution formula specified in subdivision 2, there
are unobligated and unexpended funds from the appropriation, the commissioner shall return
these funds to the coronavirus relief fund by November 1, 2020.
