  1.3             every two years for drivers over age 70; amending 
  1.4             Minnesota Statutes 1996, section 171.27; Minnesota 
  1.5             Statutes 1997 Supplement, section 171.06, subdivision 
  1.6             2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.9   171.06, subdivision 2, is amended to read: 
  1.10     Subd. 2.  [FEES.] (a) The fees for a license and Minnesota 
  1.11  identification card are as follows: 
  1.12  Classified Driver License    D-$18.50 C-$22.50 B-$29.50 A-$37.50
  1.13  Classified Under 21 D.L.     D-$18.50 C-$22.50 B-$29.50 A-$17.50
  1.14  Instruction Permit                                        $ 9.50
  1.15  Duplicate License or
  1.16   duplicate identification card                            $ 8.00
  1.17  Minnesota identification card or Under-21 Minnesota
  1.18   identification card, other than duplicate,
  1.19   except as otherwise provided in section 171.07,
  1.20   subdivisions 3 and 3a                                    $12.50
  1.21     (b) The fees under paragraph (a) are reduced by one-half 
  1.22  for each renewal of a driver's license by a person over age 70 
  1.23  under section 171.27, paragraph (a), clause (2). 
  1.24     Sec. 2.  Minnesota Statutes 1996, section 171.27, is 
  1.25  amended to read: 
  1.26     171.27 [EXPIRATION OF LICENSES.] 
  2.1      (a) The expiration date for each driver's license, other 
  2.2   than under-21 licenses, is as follows: 
  2.3      (1) for a driver over the age of 70 years, the birthday of 
  2.4   the driver in the second year following the date of issuance of 
  2.5   the license; and 
  2.6      (2) for all other drivers, the birthday of the driver in 
  2.7   the fourth year following the date of issuance of the 
  2.8   license except as otherwise provided in this section. 
  2.9      (b) The birthday of the driver shall be as indicated on the 
  2.10  application for a driver's license.  A license may be renewed on 
  2.11  or before expiration or within one year after expiration upon 
  2.12  application, payment of the required fee, and passing the 
  2.13  examination required of all drivers for renewal.  Driving 
  2.14  privileges shall be extended or renewed on or preceding the 
  2.15  expiration date of an existing driver's license unless the 
  2.16  commissioner believes that the licensee is no longer qualified 
  2.17  as a driver.  
  2.18     (c) The expiration date for each under-21 license shall be 
  2.19  the 21st birthday of the licensee.  Upon the licensee attaining 
  2.20  the age of 21 and upon the application, payment of the required 
  2.21  fee, and passing the examination required of all drivers for 
  2.22  renewal, a driver's license shall be issued unless the 
  2.23  commissioner determines that the licensee is no longer qualified 
  2.24  as a driver. 
  2.25     (d) The expiration date for each provisional license issued 
  2.26  before August 1, 1989, is the 19th birthday of the licensee.  
  2.27  When a holder of a provisional license attains the age of 19, 
  2.28  requires a duplicate license, or wants to obtain an updated 
  2.29  under-21 license, and upon the payment of a $5 application fee 
  2.30  and passing the examination required for renewal, an under-21 
  2.31  driver's license must be issued unless the commissioner believes 
  2.32  that the licensee is no longer qualified as a driver.  The 
  2.33  expiration date of an under-21 license is the person's 21st 
  2.34  birthday.  
  2.35     (e) Any valid Minnesota driver's license issued to a person 
  2.36  then or subsequently on active duty with the Armed Forces of the 
  3.1   United States, or the person's spouse, shall continue in full 
  3.2   force and effect without requirement for renewal until 90 days 
  3.3   after the date of the person's discharge from such service, 
  3.4   provided that a spouse's license must be renewed if the spouse 
  3.5   is residing within the state at the time the license expires or 
  3.6   within 90 days after the spouse returns to Minnesota and resides 
  3.7   within the state.
