A bill for an act
relating to attorneys; modifying and removing provisions limiting the practice
of law by deputy sheriffs and coroners; amending Minnesota Statutes 2008,
section 387.13.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 387.13, is amended to read:


387.13 PROHIBITIONS.

No sheriffnew text begin ornew text end deleted text begin ,deleted text end deputy sheriffdeleted text begin , or coronerdeleted text end shall appear or practice as an attorney,
solicitor, or counselor at law in any court, or draw or fill up any process, pleading, or
paper for any party in any action or proceeding, nor, with intent to be employed in the
collection of any demand or the service of any process, advise or counsel any person to
commence an action or proceedingdeleted text begin ; nor shall anydeleted text end new text begin .new text end new text begin This prohibition does not apply to a
deputy sheriff who is acting with the approval of the appointing sheriff and whose law
enforcement duties do not have a material nexus with potential legal proceedings for
which the deputy sheriff counsels clients.
