  1.1                          A bill for an act 
  1.2             relating to human services; changing provisions in the 
  1.3             medical assistance prepayment demonstration project; 
  1.4             amending Minnesota Statutes 2000, section 256B.69, 
  1.5             subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 256B.69, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [LIMITATION OF CHOICE.] The commissioner shall 
  1.10  develop criteria to determine when limitation of choice may be 
  1.11  implemented in the experimental counties.  The criteria shall 
  1.12  ensure that all eligible individuals in the county have 
  1.13  continuing access to the full range of medical assistance 
  1.14  services as specified in subdivision 6.  The commissioner shall 
  1.15  exempt the following persons from participation in the project, 
  1.16  in addition to those who do not meet the criteria for limitation 
  1.17  of choice:  (1) persons eligible for medical assistance 
  1.18  according to section 256B.055, subdivision 1; (2) persons 
  1.19  eligible for medical assistance due to blindness or disability 
  1.20  as determined by the social security administration or the state 
  1.21  medical review team, unless:  (i) they are 65 years of age or 
  1.22  older, or (ii) they reside in Itasca county or they reside in a 
  1.23  county in which the commissioner conducts a pilot project under 
  1.24  a waiver granted pursuant to section 1115 of the Social Security 
  1.25  Act; (3) recipients who currently have private coverage through 
  2.1   a health maintenance organization; (4) recipients who are 
  2.2   eligible for medical assistance by spending down excess income 
  2.3   for medical expenses other than the nursing facility per diem 
  2.4   expense; (5) recipients who receive benefits under the Refugee 
  2.5   Assistance Program, established under United States Code, title 
  2.6   8, section 1522(e); (6) children who are both determined to be 
  2.7   severely emotionally disturbed and receiving case management 
  2.8   services according to section 256B.0625, subdivision 20; and (7) 
  2.9   adults who are both determined to be seriously and persistently 
  2.10  mentally ill and received case management services according to 
  2.11  section 256B.0625, subdivision 20; and (8) children who are 
  2.12  currently enrolled in school and receiving mental health 
  2.13  services at the school by a licensed health care or social 
  2.14  services practitioner.  Children under age 21 who are in foster 
  2.15  placement may enroll in the project on an elective basis.  
  2.16  Individuals excluded under clauses (6) and (7) may choose to 
  2.17  enroll on an elective basis.  The commissioner may allow persons 
  2.18  with a one-month spenddown who are otherwise eligible to enroll 
  2.19  to voluntarily enroll or remain enrolled, if they elect to 
  2.20  prepay their monthly spenddown to the state.  Beginning on or 
  2.21  after July 1, 1997, the commissioner may require those 
  2.22  individuals to enroll in the prepaid medical assistance program 
  2.23  who otherwise would have been excluded under clauses (1) and (3) 
  2.24  and under Minnesota Rules, part 9500.1452, subpart 2, items H, 
  2.25  K, and L.  Before limitation of choice is implemented, eligible 
  2.26  individuals shall be notified and after notification, shall be 
  2.27  allowed to choose only among demonstration providers.  The 
  2.28  commissioner may assign an individual with private coverage 
  2.29  through a health maintenance organization, to the same health 
  2.30  maintenance organization for medical assistance coverage, if the 
  2.31  health maintenance organization is under contract for medical 
  2.32  assistance in the individual's county of residence.  After 
  2.33  initially choosing a provider, the recipient is allowed to 
  2.34  change that choice only at specified times as allowed by the 
  2.35  commissioner.  If a demonstration provider ends participation in 
  2.36  the project for any reason, a recipient enrolled with that 
  3.1   provider must select a new provider but may change providers 
  3.2   without cause once more within the first 60 days after 
  3.3   enrollment with the second provider.
