  1.2             relating to transportation; appropriating money to the 
  1.3             metropolitan council for regular route transit 
  1.4             operating assistance and to the commissioner of 
  1.5             transportation for Greater Minnesota transit operating 
  1.6             assistance; changing formula used to calculate fixed 
  1.7             local shares for Greater Minnesota transit systems 
  1.8             receiving state operating assistance; appropriating 
  1.9             money; amending Minnesota Statutes 1996, sections 
  1.10            174.22, subdivisions 10 and 13; 174.24, subdivision 
  1.11            3b; repealing Minnesota Statutes 1996, section 174.22, 
  1.12            subdivision 9. 
  1.13  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.14     Section 1.  [APPROPRIATIONS.] 
  1.15     Subdivision 1.  [METROPOLITAN TRANSIT.] $8,600,000 is 
  1.16  appropriated from the general fund to the metropolitan council 
  1.17  for fiscal year 1999 for operating assistance for regular route 
  1.18  transit the council operates. 
  1.19     Subd. 2.  [GREATER MINNESOTA TRANSIT.] $2,900,000 is 
  1.20  appropriated from the general fund to the commissioner of 
  1.21  transportation for fiscal year 1999 for operating assistance to 
  1.22  public transit systems receiving assistance under Minnesota 
  1.23  Statutes, section 174.24.  Of this appropriation: 
  1.24     (1) $2,400,000 is for the Access to Jobs and Training 
  1.25  program established in Laws 1997, chapter 159, article 1, 
  1.26  section 2, subdivision 3, paragraph (c); 
  1.27     (2) $300,000 is for operating assistance to public transit 
  1.28  systems presently receiving operating assistance from the 
  1.29  commissioner; and 
  2.1      (3) $200,000 is for costs relating to the formula changes 
  2.2   in sections 2 to 5. 
  2.3      Sec. 2.  Minnesota Statutes 1996, section 174.22, 
  2.4   subdivision 10, is amended to read: 
  2.5      Subd. 10.  [URBANIZED AREA SERVICE.] "Urbanized area 
  2.6   service" means a transportation service operating in an urban 
  2.7   area of more than 50,000 persons, including service provided by 
  2.8   the Duluth transit authority other than elderly and handicapped 
  2.9   service, but does not include elderly and handicapped service, 
  2.10  as defined in subdivision 13. 
  2.11     Sec. 3.  Minnesota Statutes 1996, section 174.22, 
  2.12  subdivision 13, is amended to read: 
  2.13     Subd. 13.  [ELDERLY AND HANDICAPPED SERVICE.] "Elderly and 
  2.14  handicapped service" means transportation service provided on a 
  2.15  regular basis in urbanized or large urbanized areas and designed 
  2.16  exclusively or primarily to serve individuals who are elderly or 
  2.17  handicapped and unable to use regular means of public 
  2.18  transportation. 
  2.19     Sec. 4.  Minnesota Statutes 1996, section 174.24, 
  2.20  subdivision 3b, is amended to read: 
  2.21     Subd. 3b.  [OPERATING ASSISTANCE.] (a) The commissioner 
  2.22  shall determine the total operating cost of any public transit 
  2.23  system receiving or applying for assistance in accordance with 
  2.24  generally accepted accounting principles.  To be eligible for 
  2.25  financial assistance, an applicant or recipient shall provide to 
  2.26  the commissioner all financial records and other information and 
  2.27  shall permit any inspection reasonably necessary to determine 
  2.28  total operating cost and correspondingly the amount of 
  2.29  assistance which may be paid to the applicant or recipient.  
  2.30  Where more than one county or municipality contributes 
  2.31  assistance to the operation of a public transit system, the 
  2.32  commissioner shall identify one as lead agency for the purpose 
  2.33  of receiving moneys under this section.  
  2.34     (b) Prior to distributing operating assistance to eligible 
  2.35  recipients for any contract period, the commissioner shall place 
  2.36  all recipients into one of the following classifications:  large 
  3.1   urbanized area service, urbanized area service, small urban area 
  3.2   service, rural area service, and elderly and handicapped 
  3.3   service.  The commissioner shall distribute funds under this 
  3.4   section so that the percentage of total operating cost paid by 
  3.5   any recipient from local sources will not exceed the percentage 
  3.6   for that recipient's classification, except as provided in an 
  3.7   undue hardship case.  The percentages shall be:  for large 
  3.8   urbanized area service, 55 percent; for urbanized area service 
  3.9   and small urban area service, 40 percent; for rural area 
  3.10  service, 35 percent; and for elderly and handicapped service, 35 
  3.11  percent.  The remainder of the total operating cost will be paid 
  3.12  from state funds less any assistance received by the recipient 
  3.13  from any federal source.  For purposes of this subdivision 
  3.14  "local sources" means all local sources of funds and includes 
  3.15  all operating revenue, tax levies, and contributions from public 
  3.16  funds, except that the commissioner may exclude from the total 
  3.17  assistance contract revenues derived from operations the cost of 
  3.18  which is excluded from the computation of total operating cost.  
  3.19     (c) If a recipient informs the commissioner in writing 
  3.20  after the establishment of these percentages but prior to the 
  3.21  distribution of financial assistance for any year that paying 
  3.22  its designated percentage of total operating cost from local 
  3.23  sources will cause undue hardship, the commissioner may reduce 
  3.24  the percentage to be paid from local sources by the recipient 
  3.25  and increase the percentage to be paid from local sources by one 
  3.26  or more other recipients inside or outside the classification, 
  3.27  provided that no recipient shall have its percentage thus 
  3.28  reduced or increased for more than two years successively.  If 
  3.29  for any year the funds appropriated to the commissioner to carry 
  3.30  out the purposes of this section are insufficient to allow the 
  3.31  commissioner to pay the state share of total operating cost as 
  3.32  provided in this paragraph, the commissioner shall reduce the 
  3.33  state share in each classification to the extent necessary. 
  3.34     Sec. 5.  [REPEALER.] 
  3.35     Minnesota Statutes 1996, section 174.22, subdivision 9, is 
  3.36  repealed. 
  4.1      Sec. 6.  [EFFECTIVE DATE.] 
  4.2      Sections 1 to 5 are effective July 1, 1998.
