A bill for an act
relating to human services; directing the commissioner of human services to allow
brain injury and community access for disability inclusion waivers customized
living services provider to transfer capacity to up to three other housing with
services settings located in Hennepin County.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

CUSTOMIZED LIVING SERVICES PROVIDER LOCATED IN HENNEPIN
COUNTY.

new text begin (a) The commissioner of human services shall allow a housing with services establishment
located in Minneapolis that provides customized living and 24-hour customized living
services for clients enrolled in the brain injury (BI) or community access for disability
inclusion (CADI) waiver and had a capacity to serve 66 clients as of July 1, 2017, to transfer
service capacity of up to 66 clients to no more than three new housing with services
establishments located in Hennepin County.

new text begin (b) Notwithstanding Minnesota Statutes, section 256B.492, the commissioner shall
determine the new housing with services establishments described under paragraph (a) meet
the BI and CADI waiver customized living and 24-hour customized living size limitation
exception for clients receiving those services at the new housing with services establishments
described under paragraph (a).
