  1.1                          A bill for an act 
  1.2             relating to retirement; volunteer firefighters relief 
  1.3             associations; increasing benefits for certain 
  1.4             volunteer firefighters who were also public employees 
  1.5             and who died during the course of employment duties in 
  1.6             the latter capacity. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [VOLUNTEER FIREFIGHTERS LUMP SUM SERVICE 
  1.9   BENEFITS.] 
  1.10     Subdivision 1.  [APPLICATION.] This section applies to a 
  1.11  person: 
  1.12     (1) who was born on August 18, 1941; 
  1.13     (2) was employed as a building inspector by the city of St. 
  1.14  Paul; 
  1.15     (3) died during the course of his employment duties as a 
  1.16  building inspector on December 24, 1997; 
  1.17     (4) began service as a volunteer firefighter for the 
  1.18  Woodbury fire department in 1980 and continued that service up 
  1.19  to the time of his death; and 
  1.20     (5) would have been eligible to retire as a volunteer 
  1.21  firefighter and receive a lump sum service pension calculated at 
  1.22  the rate of $4,000 for each year of service on January 1, 1998. 
  1.23     Subd. 2.  [ELIGIBILITY FOR BENEFIT.] Notwithstanding any 
  1.24  law to the contrary, the surviving spouse of a person described 
  1.25  in subdivision 1 is entitled to receive a survivor benefit from 
  1.26  the Woodbury fire department calculated at the rate that would 
  2.1   have been in effect had the person described in subdivision 1 
  2.2   lived until January 1, 1998. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective the day following final enactment.
