  1.1                          A bill for an act 
  1.2             relating to the environment; requiring a risk 
  1.3             evaluation for certain water quality and safe drinking 
  1.4             water standards; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 115. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [115.445] [WATER QUALITY AND HEALTH STANDARDS.] 
  1.8      When establishing or revising water quality standards or 
  1.9   safe drinking water standards, the commissioner of the pollution 
  1.10  control agency and the commissioner of health, respectively, 
  1.11  must determine: 
  1.12     (1) whether the standards take into account any health 
  1.13  risks to male and female infants, male and female children, and 
  1.14  male and female adults, in order to protect the health of each 
  1.15  group with a margin of safety; and 
  1.16     (2) whether the standards adequately protect health with a 
  1.17  margin of safety by taking into consideration each of the 
  1.18  following specific risks: 
  1.19     (i) adverse reproductive outcomes; 
  1.20     (ii) respiratory disease; 
  1.21     (iii) immunologic suppression; 
  1.22     (iv) cancer; 
  1.23     (v) neurological development; 
  1.24     (vi) endocrinal (hormonal) functioning; 
  1.25     (vii) general infant and child development; and 
  2.1      (viii) any other important health outcomes identified by 
  2.2   the commissioner. 
  2.3      Sec. 2.  [115.446] [SAFEGUARDING STANDARDS.] 
  2.4      Subdivision 1.  [NECESSARY RISK STANDARD.] If the 
  2.5   commissioner of the pollution control agency or the commissioner 
  2.6   of health determines that a standard under that commissioner's 
  2.7   authority does not satisfy the requirements of section 115.445, 
  2.8   the commissioner must establish a risk standard that satisfies 
  2.9   the requirements. 
  2.10     Subd. 2.  [MINIMIZATION OF RISK.] If either commissioner 
  2.11  under subdivision 1 is unable to determine whether a standard 
  2.12  satisfies the requirements of section 115.445, the commissioner 
  2.13  must identify methods to minimize or prevent exposure to the 
  2.14  human population.
