  1.1                          A bill for an act 
  1.2             relating to state government; regulating rulemaking; 
  1.3             providing for a study of broad rulemaking delegations. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [STUDY.] 
  1.6      The legislative coordinating commission, or a subcommittee 
  1.7   appointed by the commission, shall report to the legislature by 
  1.8   January 15, 1999, on broad statutory delegations of rulemaking 
  1.9   authority to state agencies.  The report shall include proposed 
  1.10  legislation to repeal or modify delegations of authority which 
  1.11  the commission believes to be overly broad.  The commission 
  1.12  shall notify appropriate policy committees of these overly broad 
  1.13  delegations, and shall encourage the committees to propose 
  1.14  legislation with more specific delegations of authority.  In its 
  1.15  study, the commission shall consider, among other delegation, 
  1.16  the authority granted in the following sections of Minnesota 
  1.17  Statutes:  16B.04, subdivision 1; 41A.04, subdivision 4; 45.023; 
  1.18  84.03; 103B.101, subdivision 7; 115B.28, subdivision 1; 
  1.19  116J.035, subdivision 2; 147.01, subdivision 3; 148.05; 148.08, 
  1.20  subdivision 3; 148.191, subdivision 2; 148.53; 148B.20, 
  1.21  subdivision 1; 148B.31; 150A.04, subdivision 5; 151.06, 
  1.22  subdivision 1; 153.02; 154.24; 156.01, subdivision 3; 175.171; 
  1.23  179A.04, subdivision 3; 182.657; 216A.07, subdivision 5; 
  1.24  216B.08; 216C.02, subdivision 3; 223.19; 239.06; 256.975, 
  2.1   subdivision 2; 268.0122, subdivision 5; 268.021; 270.06;
