  1.1                          A bill for an act 
  1.2             relating to health reporting; requiring tobacco 
  1.3             manufacturers to report hazardous substances in their 
  1.4             products; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 461; repealing Minnesota Statutes 
  1.6             1997 Supplement, section 461.17. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [461.175] [MANUFACTURERS TO REPORT CERTAIN 
  1.9   HAZARDOUS SUBSTANCES TO ASSIST IN ENFORCEMENT OF LOCAL 
  1.10  ORDINANCES.] 
  1.11     Subdivision 1.  [ANNUAL REPORT REQUIRED.] Each manufacturer 
  1.12  of tobacco products sold in Minnesota shall provide the 
  1.13  commissioner of health with an annual report, in a form and at a 
  1.14  time specified by the commissioner, identifying, for each brand 
  1.15  of tobacco product, all hazardous substances present in 
  1.16  detectable levels in the product in its unburned state and if 
  1.17  the product is typically burned when consumed, in its burned 
  1.18  state and the amount or concentration of each hazardous 
  1.19  substance present in the product's unburned state and, if 
  1.20  applicable, the burned state.  For the purposes of this section, 
  1.21  "hazardous substance" means the substances listed in tables 7 
  1.22  and 8 on pages 86 to 89 of the 1989 report of the surgeon 
  1.23  general entitled "Reducing the Health Consequences of Smoking."  
  1.24  If a manufacturer believes that any such substance is safe when 
  1.25  chewed or inhaled at typical rates of consumption, the 
  1.26  manufacturer shall provide with the report any scientific, 
  2.1   peer-reviewed evidence that supports its belief.  Reports under 
  2.2   this section are public data, and shall identify the analytical 
  2.3   method used and level of detection. 
  2.4      Subd. 2.  [ASSISTANCE TO CITIES.] Upon request, the 
  2.5   commissioner shall provide a local unit of government with a 
  2.6   copy of reports filed under this section, to assist in the 
  2.7   enforcement of local ordinances. 
  2.8      Sec. 2.  [REPEALER.] 
  2.9      Minnesota Statutes 1997 Supplement, section 461.17, is 
  2.10  repealed.
