  1.1                          A bill for an act 
  1.2             relating to tobacco litigation; requiring that the use 
  1.3             of proceeds be subject to appropriation by law; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [1.43] [TOBACCO LITIGATION; PROCEEDS.] 
  1.8      The proceeds from any litigation in state or federal court 
  1.9   or from any agreement that might affect the state's position in 
  1.10  litigation in state or federal court, that is related in any way 
  1.11  to the use of, health effects of or commerce in tobacco, to 
  1.12  which the state of Minnesota is a party or from which the state 
  1.13  obtains a benefit, must be deposited in the state treasury 
  1.14  without conditions and be subject to appropriation as provided 
  1.15  by the Minnesota Constitution, article XI, section 1.  The state 
  1.16  may not agree to or be bound by a settlement of or judgment in 
  1.17  such litigation or enter an agreement that imposes conditions 
  1.18  that are inconsistent with this section. 
  1.19     Sec. 2.  [EFFECTIVE DATE.] 
  1.20     Section 1 is effective the day following final enactment.
