  1.1                          A bill for an act 
  1.2             relating to education finance; creating an equalized 
  1.3             aid and levy to pay for one-half of up to $150 per 
  1.4             pupil of each school district's unfunded special 
  1.5             education costs; proposing coding for new law in 
  1.6             Minnesota Statutes, chapter 125A. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [125A.795] [UNFUNDED SPECIAL EDUCATION COSTS.] 
  1.9      Subdivision 1.  [SPECIAL EDUCATION CROSS-SUBSIDY 
  1.10  REVENUE.] A school district is eligible for special education 
  1.11  cross-subsidy revenue equal to the lesser of: 
  1.12     (1) $75 times its adjusted marginal cost pupil units for 
  1.13  that year; or 
  1.14     (2) one-half of its adjusted cross-subsidy revenue for the 
  1.15  second previous year. 
  1.16     Subd. 2.  [LEVY.] A school district's special education 
  1.17  adjusted cross-subsidy levy equals the district's special 
  1.18  education cross-subsidy revenue times the lesser of one, or the 
  1.19  ratio of the quotient of the district's adjusted net tax 
  1.20  capacity for the year preceding the year the levy is certified 
  1.21  by the adjusted marginal cost pupil units in the district for 
  1.22  the school year to which the levy is attributable, to $8,000. 
  1.23     Subd. 3.  [AID.] A district's special education adjusted 
  1.24  cross-subsidy aid equals the difference between the district's 
  1.25  special education cross-subsidy revenue and its cross-subsidy 
  1.26  levy. 
  2.1      [EFFECTIVE DATE.] This section is effective for revenue for 
  2.2   fiscal year 2004.
