  1.1                          A bill for an act 
  1.2             relating to state government; placing limitations on 
  1.3             use of consultants; adding money saved to the general 
  1.4             education basic formula allowance; appropriating money.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [REDUCTION IN CONSULTANT CONTRACT 
  1.7   EXPENDITURES.] 
  1.8      During the biennium ending June 30, 2003, the governor must 
  1.9   reduce planned executive branch state agency general fund 
  1.10  expenditures on contracts for professional or technical services 
  1.11  by at least $100,000,000.  The governor must allocate this 
  1.12  reduction among executive branch state agencies.  For purposes 
  1.13  of this section, "professional or technical services" has the 
  1.14  meaning given in Minnesota Statutes, section 16C.08, and 
  1.15  "executive branch state agency" has the meaning given in 
  1.16  Minnesota Statutes, section 16A.011, subdivision 12a.  The base 
  1.17  for these reductions is the amount allocated for professional or 
  1.18  technical service contracts in agency spending plans as of 
  1.19  January 1, 2002. 
  1.20     Sec. 2.  [MORATORIUM ON CONSULTANT CONTRACTS.] 
  1.21     An entity in the executive, legislative, or judicial branch 
  1.22  of state government may not enter into a new contract or renew 
  1.23  an existing contract for professional or technical services 
  1.24  after the effective date of this section and before July 1, 
  1.25  2003.  This section does not apply to a contract that: 
  2.1      (1) relates to a threat to public health, welfare, or 
  2.2   safety that threatens the functioning of government, the 
  2.3   protection of property, or the health or safety of people; or 
  2.4      (2) is paid for entirely with federal funds received before 
  2.5   the effective date of this section. 
  2.6      Sec. 3.  [FISCAL YEAR 2003 GENERAL EDUCATION REVENUE.] 
  2.7      Subdivision 1.  [REVENUE.] For fiscal year 2003 only, the 
  2.8   general education basic formula allowance under Minnesota 
  2.9   Statutes, section 126C.10, subdivision 2, is increased by $100. 
  2.10     Subd. 2.  [APPROPRIATION.] $100,000,000 is appropriated in 
  2.11  fiscal year 2003 from the general fund to the commissioner of 
  2.12  children, families, and learning to make the additional general 
  2.13  education revenue payments required under subdivision 1. 
  2.14     Sec. 4.  [EFFECTIVE DATE.] 
  2.15     Sections 1 and 2 are effective the day following final 
  2.16  enactment.  Section 3 is effective July 1, 2002.
