A bill for an act
relating to human services; modifying payment rates for nursing homes;
amending Minnesota Statutes 2004, section 256B.431, by adding subdivisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 256B.431, is amended by adding a
subdivision to read:

calculation of total payment rates for all nursing homes for the rate year beginning October
1, 2006, the commissioner shall calculate the median payment rate for each case mix class
in each economic development region as defined in section 462.385, subdivision 1. The
median for each case mix class for each facility's economic development region shall
appear on the facility's rate notice for the rate year beginning October 1, 2006.

Sec. 2.

Minnesota Statutes 2004, section 256B.431, is amended by adding a
subdivision to read:

new text begin Private pay rates after October 1, 2006. new text end

new text begin Beginning October 1, 2006,
the prohibition in section 256B.48, subdivision 1, on charging a private pay resident more
than the medical assistance rate for a multiple bed room for the resident's case mix class
shall not apply in classes where the nursing facility's payment rate is less than the median
payment rate for that class calculated in subdivision 1. For these classes, the facility
is prohibited from charging private pay residents in multiple bed rooms more than the
median rate determined in subdivision 1.

Sec. 3.

Minnesota Statutes 2004, section 256B.431, is amended by adding a
subdivision to read:

new text begin Annual updates required after October 1, 2007. new text end

new text begin Beginning with the
October 1, 2007, rate year, the commissioner shall annually update the median total
payment rate for each case mix class by economic development region and report those
figures to facilities on the rate notices. The medians reported on the rate notices shall
continue to serve as the limit on charges to private pay residents for multiple bed rooms as
described in subdivision 2.
