  1.1                          A bill for an act 
  1.2             relating to state government; prohibiting capital 
  1.3             funding if building data is not maintained; modifying 
  1.4             designer review process for higher education projects; 
  1.5             amending Minnesota Statutes 1998, section 16B.33, 
  1.6             subdivision 3a; proposing coding for new law in 
  1.7             Minnesota Statutes, chapter 16A. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [16A.633] [CAPITAL FUNDING CONTINGENT ON 
  1.10  MAINTAINING DATA.] 
  1.11     Subdivision 1.  [STATE AGENCIES.] Each state agency shall 
  1.12  provide to the commissioner of administration the data necessary 
  1.13  for the commissioner to maintain the department's database on 
  1.14  the location, description, and condition of state-owned 
  1.15  facilities.  The data must be provided by December 15 each 
  1.16  year.  The commissioner of administration must maintain both the 
  1.17  current inventory data and historical data.  A state agency is 
  1.18  not eligible to receive capital funding unless the agency has 
  1.19  provided the data required. 
  1.20     Subd. 2.  [MINNESOTA STATE COLLEGES AND UNIVERSITIES.] The 
  1.21  board of trustees of the Minnesota state colleges and 
  1.22  universities shall establish and maintain data on the location, 
  1.23  description, and condition of board-owned facilities that is 
  1.24  comparable with the database established by the department of 
  1.25  administration.  The data must be updated annually and the board 
  1.26  must maintain both current inventory data and historical data.  
  2.1   The board is not eligible to receive capital funding unless the 
  2.2   board has established and maintains the data required. 
  2.3      Subd. 3.  [UNIVERSITY OF MINNESOTA.] The board of regents 
  2.4   of the University of Minnesota is requested to establish and 
  2.5   maintain data on the location, description, and condition of 
  2.6   university-owned facilities that is comparable with the database 
  2.7   established by the department of administration.  The university 
  2.8   is requested to update the data annually and maintain both 
  2.9   current inventory data and historical data.  The board of 
  2.10  regents is not eligible to receive capital funding unless the 
  2.11  board has established and maintains the data required. 
  2.12     Sec. 2.  Minnesota Statutes 1998, section 16B.33, 
  2.13  subdivision 3a, is amended to read: 
  2.14     Subd. 3a.  [HIGHER EDUCATION PROJECTS.] (a) When the 
  2.15  University of Minnesota or the Minnesota state colleges and 
  2.16  universities undertakes a project involving construction or 
  2.17  major remodeling, as defined in section 16B.335, subdivision 1, 
  2.18  with an estimated cost greater than $2,000,000 or a planning 
  2.19  project with estimated fees greater than $200,000, the system 
  2.20  shall submit a written request for a primary designer to the 
  2.21  commissioner, as provided in this subdivision and subdivision 3. 
  2.22     (b) When the University of Minnesota or the Minnesota state 
  2.23  colleges and universities undertakes a project involving 
  2.24  renovation, repair, replacement, or rehabilitation, the system 
  2.25  office may submit a written request for a primary designer to 
  2.26  the commissioner as provided in this subdivision and subdivision 
  2.27  3. 
  2.28     (c) Notwithstanding subdivision 2, paragraph (a), and in 
  2.29  place of the agency representation under subdivision 2, 
  2.30  paragraph (b), for higher education projects under this 
  2.31  subdivision the designer review board must be increased by two 
  2.32  members.  The board of regents of the University of Minnesota 
  2.33  must nominate a person for appointment by the commissioner to 
  2.34  the board to select a designer for projects at the University of 
  2.35  Minnesota and the state colleges and universities.  The board of 
  2.36  trustees of the Minnesota state colleges and universities must 
  3.1   nominate a person for appointment by the commissioner to the 
  3.2   board to select a designer for projects at the state colleges 
  3.3   and universities and the University of Minnesota.  For projects 
  3.4   at the University of Minnesota or the state colleges and 
  3.5   universities, the board must select at least two primary 
  3.6   designers under subdivision 4 for recommendation to the board of 
  3.7   regents or the board of trustees.  The board of regents or the 
  3.8   board of trustees must notify the commissioner of the designer 
  3.9   selected from the recommendations.
