A bill for an act
relating to human services; requiring commissioner of health to submit requests
for federal funds for review; amending Minnesota Statutes 2016, section 144.074.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 144.074, is amended to read:


144.074 FUNDS RECEIVED FROM OTHER SOURCES.

new text begin (a) new text end The state commissioner of health may receive and accept money, property, or services
from any person, agency, or other source for any public health purpose within the scope of
statutory authority. All money so received is annually appropriated for those purposes in
the manner and subject to the provisions of law applicable to appropriations of state funds.

new text begin (b) Notwithstanding sections 3.3005 and 4.07, before submitting a request for federal
funds, the commissioner must submit a summary of a proposed federal funds request to the
legislature. The summary must include information about the purpose of the requested
federal funds, the history of federal funds provided for the same purpose, the total amount
of requested federal funds, the extent to which there is a requirement for the state to match
the federal funds, the number of existing or new staff that will be supported by the federal
funds, whether the federal funds request is ongoing or onetime, and whether any state
commitment of funds or personnel will be required when the proposed request for federal
funds expires.

new text begin (c) The Legislative Advisory Commission, under section 3.30, subdivision 2, shall review
and make a recommendation on the federal funds request under paragraph (b). If the
Legislative Advisory Commission makes a negative recommendation or a request for more
information during the 20-day period beginning the day the commissioner submits the
request, the commissioner shall not submit the request for federal funds. If the Legislative
Advisory Commission makes a positive recommendation or no recommendation during the
20-day period beginning the day the commissioner submits the request or after receiving
more information, the commissioner may submit the request for federal funds. A
recommendation of the commission must be made at a meeting of the commission unless
a written recommendation is signed by a majority of all members entitled to vote on the
federal funds request.
