  1.1                          A bill for an act 
  1.2             relating to Anoka county; allowing use of certain 
  1.3             county facilities for commercial wireless service 
  1.4             providers and allowing the lease of sites for public 
  1.5             safety communications equipment. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [RADIO SYSTEM.] 
  1.8      Anoka county may establish and rent, lease, construct, 
  1.9   equip, and maintain a radio broadcasting station or stations, 
  1.10  with land-fixed repeater stations and other necessary 
  1.11  communication equipment, to be used for public safety 
  1.12  communications.  It may acquire land, towers, or equipment by 
  1.13  gift, purchase, lease, exchange, condemnation, or other means 
  1.14  for use as a site for public safety communications equipment.  
  1.15  Public safety communications sites may be acquired by lease for 
  1.16  a period of up to 25 years in duration.  Public safety 
  1.17  communications may include police, fire, highway maintenance, 
  1.18  emergency medical service, local government, forestry 
  1.19  conservation, and other communications as determined by the 
  1.20  Anoka county board. 
  1.21     Sec. 2.  [ANTENNA SITE USE AGREEMENTS.] 
  1.22     Use of Anoka county-owned radio towers, building rooftops, 
  1.23  lands, rights-of-way, and easements may be made available to 
  1.24  commercial wireless service providers or other users for the 
  1.25  purpose of installing antennas and equipment.  Anoka county may 
  2.1   charge site use fees for the value of the real property or 
  2.2   structure made available.  In lieu of a site use fee, Anoka 
  2.3   county may make agreements with commercial wireless service 
  2.4   providers or other tower owners to place county equipment on 
  2.5   privately owned towers and may accept improvements such as tower 
  2.6   reinforcement, reconstruction, site development, or other site 
  2.7   improvements to Anoka county's communications system facilities 
  2.8   or real or personal property.  Antenna site use agreements and 
  2.9   leases may be entered into by any means available and in the 
  2.10  manner determined by the Anoka county board, with or without 
  2.11  advertisement for bids. 
  2.12     Sec. 2.  [EFFECTIVE DATE; LOCAL APPROVAL.] 
  2.13     Section 1 is effective the day after the governing body of 
  2.14  Anoka county and its chief clerical officer timely complete 
  2.15  their compliance with Minnesota Statutes, section 645.021, 
  2.16  subdivisions 2 and 3.
