  1.4             state forests; providing for all-terrain vehicle use 
  1.5             in certain wildlife management areas; amending 
  1.6             Minnesota Statutes 1998, section 97A.135, subdivision 
  1.7             2a; proposing coding for new law in Minnesota 
  1.8             Statutes, chapter 97A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [LEGISLATIVE FINDINGS; PURPOSE.] 
  1.11     Consolidated conservation lands are state-owned lands under 
  1.12  the management, operation, and control of the commissioner of 
  1.13  natural resources pursuant to Minnesota Statutes, section 
  1.14  84A.55.  Ownership arises through legislative acts in 1929, 
  1.15  1931, and 1933 that created the Red Lake game preserve in 
  1.16  Beltrami, Koochiching, and Lake of the Woods counties, and 
  1.17  reforestation areas and projects in Aitkin, Mahnomen, Marshall, 
  1.18  and Roseau counties.  By assuming the responsibility to pay 
  1.19  outstanding principal and interest on bonds issued by the 
  1.20  counties in connection with drainage projects in the areas, the 
  1.21  state of Minnesota obtained absolute title, free from any trusts 
  1.22  in favor of the taxing districts, to tax forfeited lands within 
  1.23  the areas. 
  1.24     Consolidated conservation lands classified as 
  1.25  nonagricultural are reserved and dedicated to conservation 
  1.26  purposes pursuant to Minnesota Statutes, section 282.22, and 
  1.27  lands classified as agricultural may be sold.  While over the 
  2.1   decades a majority of the consolidated conservation lands have 
  2.2   been designated into management units or sold, there remain 
  2.3   lands in each of the counties that have not been formally 
  2.4   designated.  It is in the public interest that the remaining 
  2.5   undesignated consolidated conservation lands be designated into 
  2.6   management units of state wildlife management areas, state 
  2.7   forests, or state scientific and natural areas. 
  2.8      Sec. 2.  [97A.133] [STATE WILDLIFE MANAGEMENT AREAS.] 
  2.9      Subdivision 1.  [ESTABLISHMENT.] State wildlife management 
  2.10  areas are established and designated as provided under this 
  2.11  section.  State wildlife management areas are located and named 
  2.12  as indicated in this section. 
  2.13     Subd. 2.  [PAYMENT IN LIEU OF TAXES.] The consolidated 
  2.14  conservation lands included in state wildlife management areas 
  2.15  are subject to the payment in lieu tax as provided in section 
  2.16  477A.12, paragraph (a), clause (3).

  4.26     Sec. 3.  Minnesota Statutes 1998, section 97A.135, 
  4.27  subdivision 2a, is amended to read: 
  4.28     Subd. 2a.  [DISPOSAL OF LAND IN WILDLIFE MANAGEMENT AREAS.] 
  4.29  (a) The commissioner may sell or exchange land in a wildlife 
  4.30  management area authorized by designation under section 86A.07, 
  4.31  subdivision 3, 97A.133, or 97A.145 if the commissioner vacates 
  4.32  the designation before the sale or exchange in accordance with 
  4.33  this subdivision.  The designation may be vacated only if the 
  4.34  commissioner finds, after a public hearing, that the disposal of 
  4.35  the land is in the public interest. 
  4.36     (b) A sale under this subdivision is subject to sections 
  5.1   94.09 to 94.16.  An exchange under this subdivision is subject 
  5.2   to sections 94.341 to 94.348. 
  5.3      (c) Revenue received from a sale authorized under paragraph 
  5.4   (a) is appropriated to the commissioner for acquisition of 
  5.5   replacement wildlife management lands. 
  5.6      (d) Land acquired by the commissioner under this 
  5.7   subdivision must meet the criteria in section 86A.05, 
  5.8   subdivision 8, and as soon as possible after the acquisition 
  5.9   must be designated as a wildlife management area under section 
  5.10  86A.07, subdivision 3, 97A.133, or 97A.145. 
  5.11     (e) In acquiring land under this subdivision, the 
  5.12  commissioner must give priority to land within the same 
  5.13  geographic region of the state as the land conveyed. 
  5.14     Sec. 4.  [ADDITIONS TO STATE FORESTS.] 
  5.15     Subdivision 1.  [89.021] [Subd. 5.] [BELTRAMI ISLAND STATE 
  5.16  FOREST.] The following areas are added to Beltrami Island state 
  5.17  forest:

 36.30     Sec. 6.  [ALL-TERRAIN VEHICLE TRAVEL WITHIN WILDLIFE 
 36.31  MANAGEMENT AREAS.] 
 36.32     Subdivision 1.  [PERMISSIBLE USE.] The use of all-terrain 
 36.33  vehicles on wildlife managament areas designated in section 5 is 
 36.34  authorized on existing state highways and county and township 
 36.35  roads as specified by the commissioner of natural resources in 
 36.36  subdivision 2.  Off-trail use of all-terrain vehicles on the 
 37.1   wildlife management areas designated in section 5 is prohibited 
 37.2   except as authorized by existing rule. 
 37.3      Subd. 2.  [DESIGNATION.] By January 1, 2001, the 
 37.4   commissioner of natural resources shall identify and specify 
 37.5   public road rights-of-way upon which all-terrain vehicle use is 
 37.6   permissible within the wildfire management areas designated in 
 37.7   section 5. 
 37.8      Sec. 7.  [INSTRUCTION TO REVISOR; EFFECT OF SESSION LAW 
 37.9   DESCRIPTIONS.] 
 37.10     (a) The revisor need not include the legal descriptions for 
 37.11  state wildlife management areas under Minnesota Statutes, 
 37.12  section 97A.133, but must include a history of the session laws 
 37.13  establishing or amending the boundaries of state wildlife 
 37.14  management areas under each subdivision in the same manner as 
 37.15  provided for state parks under Minnesota Statutes, section 
 37.16  85.012.  
 37.17     (b) The lands described in the session laws establishing or 
 37.18  changing the boundaries of each state wildlife management area 
 37.19  are included in the state wildlife management areas as 
 37.20  established or changed. 
 37.21     Sec. 8.  [EFFECTIVE DATE.] 
 37.22     Sections 1 to 7 are effective the day following final 
 37.23  enactment.
